ORDER 1. This appeal is directed against an order dated 31st March, 2021 passed by the learned Single Judge in SB Civil Writ Petition No.1474/2021. By the said order while issuing notice in the writ petition, the learned Single Judge has refused to grant stay order as prayed for. 2. Having heard the learned counsel for the parties and having perused the documents on record, what we gather is that the petitioner objects to exhibition of certain teaser and a film produced and exhibited by respondent No. 4 to 6 on the ground that the same depicts certain scenes showing the actors smoking cigarettes which is not permissible as per the rules and regulations framed by the Government of India. 3. The counsel for the private respondents submitted that the exhibition of such scene is not completely banned, the only requirement is that the statutory warning should be flashed. 4. These issues require further consideration and cannot be dealt with at interim stage, therefore, the learned Single Judge has rightly did not grant stay. We find no merit in the appeal and the same is dismissed.. S.B. Civil Writ Petition No.1474/2021:- 5. This petition is filed in the nature of public interest litigation, we do not understand how it was placed before the learned Single Judge. The same be placed before the Division Bench after the petitioner supplies second set of the compilation. 6. List on 15.03.2022.
