JUDGMENT (Prayer: W.P.(MD) No.3874 of 2022 filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to take appropriate action against the illegal reservation made by the officers those who are reserved during 04.12.2018 to 26.12.2019 and same to be recovered from the officers by considering the petitioner's representation dated 16.09.2021.) Paresh Upadhyay, J. 1. This petition is styled as public interest litigation. 2. The petitioner seeks direction from this Court against the respondent authorities of Southern Railways starting from the rank of Chief Commercial Manger, Chennai to the Senior Divisional Commercial Manager at Madurai, for the job which they have done in heavy raining nights, of providing alternative transportation to the passengers, when trains could not take the them to the destinations. 3. According to the petitioner, the expenses incurred in that emergent circumstances is the loss to the Railway for which action needs to be taken against the officers. 4. Learned Advocate for the petitioner has taken this Court through an undated representation made by him, which is claimed to have been sent to the authorities on 16.09.2021. It refers to the period from December 2018 to February 2019. We find that the action of the Railway Authorities, which ought to have been appreciated by the citizens at large, is sought to be condemned by the petitioner with further prayer that action needs to be taken against the Railway Authorities. 5. We are afraid, not only no such direction can be issued, but such petition can not be entertained at all. If this petition is dismissed simpliciter, it would be an acknowledgement of the armtwisting tactic by ungrateful element of the society like the petitioner and therefore it is ordered that an amount of Rs.10,000/- shall be paid by the petitioner, as token cost and that amount shall be sent to the Chief Commercial Manager, Southern Railway, Chennai, within a period of 15 days from today by a Demand Draft of a Nationalized Bank. The compliance thereof shall be reported to this Court on 28.03.2022. 6. In view of above the following order is passed: 6.1 This petition is dismissed with cost of Rs.10,000/-.
