JUDGMENT 1. Leave granted. 2. The dependents of the deceased Ram Bahadur Yadav are in appeal, aggrieved against the order dtd. 13/1/2021, whereby the compensation awarded as Rs.13,62,730.00 by the Motor Accident Claims Tribunal was reduced to Rs.8,80,707.50 by the High Court by taking into consideration minimum wages payable to a workman. 3. The only dispute survives in the present appeal is to the amount of compensation payable to the appellants. The statement of the Appellant Number 1, wife of the deceased in the witness box was that her husband was giving her Rs.10,000.00 per month a family expense. However, the Tribunal deducted Rs.2000.00 as the personal expenses of the deceased and assessed the dependency as Rs.8000.00 per month and consequently, assessed the dependency as Rs.12,48,000.00, after applying the multiplier of 13. 4. It is the stand of the appellants that the deceased was running a shop and therefore, he cannot be treated to be a daily wager, as observed by the High Court. Since the appellant has stated that Rs.10,000.00 was being contributed by the deceased to the affairs of the family, a fact which is found by the Investigator of the Insurance Company as well, we find that the amount of Rs.8000.00 found by the Claims Tribunal, cannot be said to be unfair or unjust. 5. However, the Tribunal has not awarded any compensation on account of future prospects in view of the Judgment of this Court in National Insurance Company Limited Vs. Pranay Sethi & Ors. reported in (2017) 16 SCC 680 . 6. Keeping in view of age of the deceased as 46, the future prospects @25% has to be given. In view of said fact, the compensation awarded would be as under:- 7. In view of the said fact, the appellants would be entitled to recover a sum of Rs.17,10,000.00 along with interest @ 7.5% p.a. awarded by the Tribunal. In view of above, the appeal is allowed.
