JUDGMENT 1. Mr. Mohapatra, learned advocate appears on behalf of petitioner, who claims to be serving Executive Officer of the temple trust. He submits, impugned is notice for payment of gratuity dated 23rd May, 2002 addressed to his client by the authority. In determining the demand said authority did not make Commissioner of Endowment party. He relies on section 69(1) in Odisha Hindu Religious Endowments Act, 1951 to submit, there has been jurisdictional error in making impugned order. 2.Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and points out, the notice is under the Act of 1972, assignment regarding which is entry no.1 in assignment list of the Hon'ble Mr. Justice, A. K. Mohapatra. 3. In view of aforesaid, the writ petition is released from the list, to be placed before the Bench having assignment.
