JUDGMENT Savitri Ratho, J. - CRLMC No. 3754 of 2022 & I.A. No. 2918 of 2022 1. This application under Section 482 Cr.P.C. has been filed by the petitioner challenging the order dated 22.11.2022 passed by the learned Sessions Judge, Balangir in Criminal Revision No. 03 of 2022 setting aside the order dated 10.08.2022 passed by the learned J.M.F.C., Loisingah in C.M.C. No. 12 of 2022 by which order the learned J.M.F.C. had directed for release of tractor bearing registration no. OR-03-V-0323 and trolley bearing registration no. OD-03-D-8762. 2. Issue notice to sole opposite party in the CRLMC as well as in the I.A. 3. Notice on behalf of sole opposite party is accepted by Mr. J. Katikia, learned Additional Government Advocate. 4. List this matter in the week commencing on 16.01.2023 in order to enable Mr. J. Katikia, learned Additional Government Advocate to obtain instructions in the matter. 5. As Mr. Jagabandhu Sahu, learned counsel for the petitioner submits that pursuant to order dated 10.08.202 passed by the learned J.M.F.C., Loisingah, the tractor and trolley have been released in custody of the petitioner, it is directed that the operation of the order dated 22.11.2022 passed by the learned Sessions Judge, Balangir in Criminal Revision No. 03 of 2022 shall remain stayed till the next date. 6. Urgent certified copy of this order be granted on proper application.
