ORDER 1. The case comes up on an application (01/2022) for early hearing of the matter. 2. For the reasons mentioned in the application, the same is allowed. 3. Heard learned counsel for the petitioner. 4. Learned counsel for the petitioner submits that the petitioner is an association under the name and style of Janta Atta Chakki Operator Association. This Association is a registered body and presently it is aggrieved of the illegal Mobile Atta Chakki/Flour Mills which are operating in the State of Rajasthan, in particular the District of Sriganganagar. 5. Learned counsel further submits that the Association has represented before the competent authority of the State Government, but no action has been taken. 6. On the notice having been issued by this Court, the Transport Department has filed reply and in the reply it has been stated that those persons who are involved in operating Mobile Atta Chakki in illegal manner in violation of the Motor Vehicles Act, 1988, they have been penalized and a sum of Rs. 2,59,794/- have been recovered from them between the period of 12.07.2017 to 14.10.2018. The department has also employed flying squad for checking the illegal activities of the Mobile Chakki operators. The appropriate proceedings for violation of the Motor Vehicles Act, 1988 are being regularly undertaken to prevent the illegal use of the Mobile Chakkis by the persons concerned. 7. The respondent Nos.8 and 9 have also filed their reply and have also assured this Court that if the Mobile Chakki Operators are undertaking their activities de-hors the law or the provisions of the Motor Vehicles Act is violated, an appropriate action in the matter will be taken by them. 8. In view of the reply filed by the Transport Department as well as the Police Department, the present writ petition is disposed of with a direction to the respondents that if any violation is noticed by the State functionaries in operation of the illegal Mobile Atta Chakkis/ Flour Mills and if the same is found to be in the violation of the Motor Vehicles Act or any other law holding the field, the State authorities shall take appropriate action strictly in accordance with law.
