JUDGMENT 1. Pursuant to the direction of this Court dated 01-12-2021 seeking clarifications from the State respondents on three aspects namely: (i) the amount of coal, which is still lying un-auctioned in the Shallang area (ii) whether all the coal, which has been auctioned, has been lifted by the successful bidders and (iii) whether the auctioned coal for which challans have been issued, but not lifted on expiry of the challans, is still present on the ground, the State respondents have filed an affidavit detailing the exact position on the ground which is based on two inspections conducted in various areas where the coal is located. The first inspection was conducted by R.Kharkongor, Executive Magistrate, West Khasi Hills District, Nongstoin and the second inspection by Shri. L.Kharmon, MCS, Extra Assistant Commissioner, Mawshynrut Civil Sub-Division, Mawshynrut together with the representatives of the Public Works Department (Roads) Nongstoin Sub-Division. The inspection reports are also accompanied with the GPS locations and photographs of the said coal where it is located. 2. Para 6 of the affidavit detailing the exact situation of the said coal for the sake of convenience is reproduced herein below: '6. That it is submitted, following the information mentioned herein above regarding the auctioned coal and the minerals transport challans, details of the above information is produced herein below for ready reference of this Hon'ble Court. The details are as follows:- i. Total auctioned coal = 60,152.48MT (5012 challans) ii. Total challans issued so far by DMR = 1900 challans (22,800 MT) iii. Challans used/coal transported = 1373 challans (16,476 MT) iv. Challans expired and need revalidation = 527 challans (6,324 MT) v. Total auctioned coal still available on ground = 43,676.48 MT vi. Lost of coal due to rain as verbally informed by the successful bidder = 55.56 MT vii. Therefore, total coal available on ground = 43,676.48 MT - 55.56 MT = 43,620.92 MT' 3. It is noted that this instant writ petition is confined to a prayer for revalidation of challans which expired and as indicated in the affidavit, is for 527 challans for an amount of 6,324 MT of coal which had been issued in favour of the petitioner. 4. It is also submitted by learned Sr. counsel for the petitioner, for the coal which had not been lifted and for which challans had been issued, Royalty, CGST and Cess had already been paid to the State. This is not disputed by learned AAG for the State respondents. 5. In view of the facts as placed on affidavit which corroborates the stand of the petitioner, this writ petition is disposed of with a direction that respondent No. 2, namely Director of Mineral Resources, Government of Meghalaya, Shillong, shall consider revalidation of the 527 challans for an amount of 6,324 MT most expeditiously. 6. With the above direction, writ petition is accordingly disposed of.
