ORDER : The grievance of the petitioner is that though he wants re-registration/transfer of registration of his car bearing Registration No. WB-02V-7470 from West Bengal to Hazaribagh, yet the same has not been done by the respondent no. 2 – the District Transport Officer, Hazaribagh merely on the ground that the code of transferee district is shown in online portal as JH-01 instead of JH-02. 2. The writ petition was initially taken up on 18.07.2022 and on the said date, this Court while showing its displeasure that the petitioner had to file the writ petition for resolving such a trivial issue, the respondent no. 2 was directed to remain physically present before this Court on the next date. It was, however, observed that if the aforesaid issue was resolved before the next date, the respondent no. 2 was not required to physically appear on the next date. Thereafter, the case was taken up on 27.07.2022 and on the said date, the submission of Mr. Mithilesh Singh, learned GA-IV was recorded, which reads as under : “Mr. Mithilesh Singh, learned G.A.-IV appearing on behalf of the respondents, submits that the respondent no. 2 has already resolved the issue of wrong mentioning of Code of transferee district (Hazaribagh) in the online portal as the said mistake has already been rectified. Subsequent to the said rectification, new registration number of Hazaribagh district having Code-02 will be given to the petitioner’s car within two days. As per instruction, the insurance policy of the said vehicle which has lapsed, is being renewed by the petitioner and will be handed over to the respondent no. 2 today itself. So far as pollution certificate is concerned, the same is also being submitted by the petitioner to the respondent no. 2. Under the said circumstance, all required exercises for granting new registration number to the petitioner’s vehicle-WB-02V-7470 will be completed within two days.” 3. Today, learned GA-IV while referring to paragraph nos. 8 and 9 of the counter affidavit filed on behalf of the respondent no. 2, submits that in compliance of order dated 18.07.2022 passed by this Court, the respondent no. 2 pursued the matter and after online correction of the code from JH-01 to JH-02, the permanent address of the petitioner at Hazaribagh was registered and Form-24 (Motor Vehicle Register) was issued. 2, submits that in compliance of order dated 18.07.2022 passed by this Court, the respondent no. 2 pursued the matter and after online correction of the code from JH-01 to JH-02, the permanent address of the petitioner at Hazaribagh was registered and Form-24 (Motor Vehicle Register) was issued. Since the vehicle in question was registered with old number WB-02V-7470, further steps were to be taken by the petitioner after issuance of Form-24 so as to allot the registration number beginning with code JH-02, however, he has not completed the same as yet. The said requirements are as follows : i. Submission of Form-27 for the purpose of re-assignment of new registration, starting with ‘JH02’ which has not been done by the petitioner. ii. Submission of Form-29 for the purpose of transfer of ownership as the petitioner wants the transfer of ownership from ‘PSP Trading Pvt. Ltd.’ to his own name. It is made clear that the petitioner has not submitted Form-29. iii. Submission of Form-30 which is an application for intimation and transfer of ownership and the same has not been submitted by the petitioner. iv. Submission of Form-25 for renewal of certificate of registration of motor vehicle in question which lapsed on 09.05.2021 and the same has also not been submitted by the petitioner. v. Submission of fresh ‘Pollution Under Check Certificate (PUCC)’ has also not been submitted by the petitioner till date. vi. Submission of renewed insurance policy which has already been renewed and submitted by the petitioner. vii. Submission of requisite fee of Rs. 47,549/- which are to be made by the petitioner for issuance of fresh registration and for other formalities. 4. Learned counsel for the petitioner submits that the aforesaid amount of Rs. 47,549/- also includes the Motor Vehicle Tax w.e.f 10.05.2021 to 08.05.2026 along with penalty of Rs. 7,244/-. Though the said penalty imposed against the petitioner is unjustified, he is ready to deposit the said amount. The petitioner shall also complete the aforesaid requirements. 5. Considering the submission of learned counsel for the parties, the present writ petition is disposed of with a direction to the respondent no. 2 to finalize the issue of re-registration/transfer of registration of the petitioner’s car within three days from the date the petitioner makes the payment of required amount as has been mentioned hereinabove and completes the aforesaid requirements.
