JUDGMENT Sudhir Mittal, J. (Oral) - The petitioners are elected panches of Gram Panchayat of Village Mari Udhoke, Block Bhikhiwind, District Tarn Taran. Their grievance is that Block Development and Panchayat Officer and District Development and Panchayat Officer are interfering in the functioning of the Panchayat and not permitting it to function smoothly. Even though representation has been made to refrain from interfering with the functioning of the Gram Panchayat, yet interference continues. 2. Learned counsel for the petitioners submits that an elected body has to be permitted to function smoothly, in accordance with the principles of Democracy. 3. There is no dispute with the submission that democratically elected institutions are to be permitted to function smoothly to enable them to carry out their functions properly. However, in case the officials are interfering in smooth functioning, the remedy lies in approaching the higher authorities instead of filing a writ petition. 4. Faced with the above-said situation, learned counsel for the petitioner wishes to withdraw the present petition with liberty to approach the higher authorities. 5. Dismissed as withdrawn with the aforementioned liberty.
