ORDER : The present writ petition has been filed for issuance of direction upon the respondent authorities particularly the respondent no. 5 – the Circle Officer, Jarmundi, Dumka to allow the petitioner to run the shop on his own land adjacent to his house, appertaining to Plot No. 38, J.B. No. 43, situated at Mouza-Khurd Belguma, PO-Basukinath, PS-Jarmundi, District-Dumka during Shravani Mela. Further prayer has been made for issuance of direction upon the respondent authorities to pay compensation to the petitioner as his shop and several articles have been damaged by the local police on the instruction of the respondent no. 5. 2. A counter affidavit has been filed on behalf of the respondent nos. 3 to 5 stating inter alia that the petitioner has been in litigation with the heirs of last recorded raiyat Sokhi Maharana with respect to 6 Kattha 19 Dhur of land, appertaining to Plot No. 38, J.B. No. 43, situated at Mouza-Khurd Belguma, who have not been arrayed as party respondents in the present case. However, so far as the petitioner’s allegation made against the respondent nos. 3 to 5 is concerned, during anti-encroachment drive by the local police and administration, only that part of the petitioner’s shop has been removed which had encroached the public road keeping in view the convenience of devotees during the Shravani Mela. 3. Learned counsel for the petitioner submits that as on date, there is no dispute between the petitioner and the heirs of last recorded raiyat Sokhi Maharana. 4. Be that as it may. The specific stand of the respondent nos. 3 to 5 is that they are not concerned with the raiyati land of the petitioner in question. However, during the anti-encroachment drive, it was found that the petitioner had encroached upon the public road and thus, part of the shop was removed for the convenience of devotees during the Shravani Mela. 5. Hence, I see no reason to entertain the petitioner’s prayer made in the present writ petition and the same is accordingly dismissed.
