JUDGMENT : 1. Heard Sri K. Laxmana Sastry, learned counsel for the petitioner, Sri G. Srinivasula Reddy, learned standing counsel for respondent No.1 and learned GP for Services-IV, representing respondents 2 & 3. 2. By means of this writ petition under Article 226 of the Constitution of India, the petitioner initially prayed for direction to modify the petitioner’s appointment order on the post of Office Subordinate, vide proceedings Rc.No.2846/2015/A2, dated 20.09.2016, on which post she was given appointment on compassionate grounds. The petitioner had submitted a representation to the Chief Executive Officer and during pendency of the petition, the same was rejected by order dated 03.01.2022. By amendment in the petition, the petitioner is also challenging the said order. 3. The petitioner’s father, namely, A. Srinivasarao, while working as Head Master, Zilla Parishad High School, Boppudi, Chilakaluripeta, died on 26.08.2013 in harness. The petitioner was minor at that time. After completion of Intermediate in April 2015, she applied for her compassionate appointment on 14.09.2015. The proposal was forwarded to the Government for relaxation of rules relating to minimum age and for condonation of shortage of 10 days. The Government accorded permission for appointment in relaxation of the rule as a special case. She was appointed on the post of Office Subordinate in the existing vacancy in Zilla Parishad High School, Veluru, Chilakaluripeta Mandal, Guntur District, vide order dated 20.09.2016. She joined on 21.09.2016. She completed graduation (BA) in April 2018. 4. It is the further case of the petitioner that she represented on 15.09.2017 for considering her candidature for the post of Junior Assistant, followed by another representation dated 13.11.2017. The Chief Executive Officer, Zilla Praja Parishad, Guntur, vide Rc.No.2846/2015/A2, dated 08.02.2018 submitted report to the Commissioner, Panchat Raj & Rural Development, Nakkal Road, Suryaraopeta, Vijayawada, upon which the Commissioner issued Memo No.8147/CPR&RD/C-2/2017, dated 20.02.2018, to the Chief Executive Officer, to consider the case, as per rules. 5. As action was not taken, the present writ petition was filed. This Court, vide order dated 29.08.2022, directed the learned counsel for the 1st respondent to obtain instructions as to what action was taken after the Memo dated 20.02.2018. 6. The 1st respondent filed memo bringing on record the order dated 03.01.2022 by which the petitioner’s case was rejected. 7. As action was not taken, the present writ petition was filed. This Court, vide order dated 29.08.2022, directed the learned counsel for the 1st respondent to obtain instructions as to what action was taken after the Memo dated 20.02.2018. 6. The 1st respondent filed memo bringing on record the order dated 03.01.2022 by which the petitioner’s case was rejected. 7. The petitioner by amendment, challenged the order dated 03.01.2022, with further prayer for the appointment on the post of Junior Assistant by modifying the order of her appointment on the post of Subordinate vide proceedings Rc.No.2846/2015/A2, dated 20.09.2016. 8. Placing reliance on G.O.Ms.No.25, dated 12.03.2015 and G.O.Ms.No.112, General Administration (Ser.A) Department, dated 18.08.2017, learned counsel for the petitioner submits that at the time of the petitioner’s appointment, her qualification was Intermediate, and later, she also acquired the qualification of Graduation. He submits that at the time of her appointment, she being Intermediate, was eligible for the post of School Assistant. She should have been given conditional appointment on the post of Junior Assistant, as provided in G.O.Ms.No.112. 9. Learned standing counsel submits that the Order dated 03.01.2022 is correctly passed. The G.O.Ms.Nos.25 & 112 are not applicable to petitioner’s case and the petition deserves to be dismissed. 10. It is relevant to reproduce G.O.Ms.No.25, dated 12.03.2015, which reads as under: “GOVERNMENT OF ANDHRA PRADESH ABSTRACT Subordinate Services – Scheme of Compassionate Appointment to the dependents of deceased employees who die in harness prior to the 12-5-2014 – Conditional appointment to the candidates who do not possess minimum Educational Qualifications to hold the post of Junior Assistant, Junior Assistant – Cum – Typist – Further orders – Issued. GENERAL ADMINISTRATION (SERVICES.A) DEPARTMENT G.O.Ms.No.25 Dated: 12-03-2015 Read the following: 1. G.O.Ms.No.133, G.A (Ser.B) Department, dt.12.05.2014. 2. G.O.Ms.No.134, G.A (Ser.B) Department, dt.12.05.2014. 3. G.O.Ms.No.135, G.A (Ser.B) Department, dt.12.05.2014. 4. From Joint Action Committee of Employees, Teachers, Workers and Pensioners, Andhra Pradesh, representation, dt.03.02.2015 ******* ORDER: In the G.O.1st read above, Government have issued orders prescribing the qualification of Proficiency in Office Automation with usage of computer and associated software for the posts of Junior Assistants, Assistant-cum-Typists, Senior Stenographers and Junior Stenographers, UD Typists, Typists, LD Typists etc., in the offices of Heads of Departments/Directorates and in the sub offices other than offices of Heads of Departments/Directorates by direct recruitment through APPSC /DSCs. 2. 2. In the G.O.2nd read above, the Government have issued orders prescribing the qualification of Proficiency in Office Automation with usage of computer and associated software after a gap of not less than 3 months from the date of short listing of candidates, for the posts of Assistant Section Officers, Senior Stenographers and Junior Stenographers, Typists-cum-Assistant in the AP Secretariat by Direct Recruitment through APPSC. 3. In the G.O.3rd read above, Government have issued orders enhancing the Education qualification of ‘Intermediate’ with ‘Degree’ for the posts of Junior Assistants, Assistant-cum-Typists, Senior Stenographers and Junior Stenographers in the District Offices. 4. In the 4th read above, Joint Action committee of Employees, Teachers, Workers and Pensioners, Andhra Pradesh, have requested the Government kindly to relax the qualification for the appointment to the dependents of deceased Government Servants whose deaths occurred before 12.05.2014 and waiting for appointment and allow them with intermediate qualification instead of Degree qualification. 5. Government after careful examination of the matter hereby order that: 1) The qualification of Intermediate/Technical qualification prescribed in the A.P.Ministerial Service Rules, 1998, prior to the amendment i.e., before the issue of G.O.Ms.No.135, General Administration (Ser.B) Department, dt:12/05/2014 for the post of Junior Assistant, Junior Assistant-cum-Typist in other than Heads of Departments be made applicable to those cases who have already submitted applications up to 11-5-2014 for appointment under compassionate grounds, subject to the condition that the candidate so appointed shall be allowed 5 years time to acquire the required qualification prescribed in the G.O.Ms.No.135, General Administration (Ser.A), dt.12-5-2014. 2) The qualification of Degree and Proficiency of Office Automation in the usage of computer and associated software introduced by a way of amendment (i.e., G.O.Ms.No.133 & 135, General Administration (Ser.B) Department, dt:12/05/2014 be made applicable to the dependants of the deceased Government employee who have submitted applications under compassionate grounds after the above said amendment, i.e., 12-5- 2014. Representation Dt.17.5.2016 of the President, AP Revenue Services Association. ******* ORDER: In the G.O.3rd read above, Government have issued orders prescribing the qualification of Proficiency in Office Automation with usage of computer and associated software for the posts of Junior Assistants, Assistant-cum-Typists, Senior Stenographers and Junior Stenographers, UD Typists, Typists, LD Typists etc., in the offices of Heads of Departments/Directorates and in the sub offices other than offices of Heads of Departments/Directorates by direct recruitment through APPSC /DSCs. 2. In the G.O.4th read above, Government have issued orders enhancing the Education qualification of ‘Intermediate’ with ‘Degree’ for the posts of Junior Assistants, Assistant-cum-Typists, Senior Stenographers and Junior Stenographers in the District offices. 3. In the G.O.5th read above, Government issued orders, inter alia, that the qualification of Degree and Proficiency of Office Automation in the usage of computer and associated software introduced by a way of amendment (i.e.,G.O.Ms.No.133 & 135, General Administration (ser.B) Department, dt:12/05/2014 be made applicable to the dependants of the deceased Government employee who have submitted applications under compassionate grounds after the above said amendment, i.e., 12-5-2014. 4. In the representation 6th read above, the President, AP Revenue Service Association has submitted that the families of the deceased employees are suffering from depression as they are unable to get proper employment to their children under the scheme of Compassionate Appointment due to the enhancement of educational qualification from Intermediate to Degree and their family status is humiliated and stooped down in the society as their children are being provided jobs in the cadre of Office Subordinates due to lack of prescribed educational qualifications. He has requested the Government to kindly issue orders for appointment of candidates of deceased employees of subordinate offices who possess atleast Intermediate qualification to consider for the post of Jr. Assistant/Typist by giving reasonable time i.e., 5 years to acquire “Degree” qualification on par with Head of Departments/Directorates and Secretariat and atleast 2 years time to qualify in the test i.e., Proficiency in Office Automation with usage of computer and association software conducted by the APPSC or the recruiting agency (DSC) as the case may be on humanitarian grounds. 5. Assistant/Typist by giving reasonable time i.e., 5 years to acquire “Degree” qualification on par with Head of Departments/Directorates and Secretariat and atleast 2 years time to qualify in the test i.e., Proficiency in Office Automation with usage of computer and association software conducted by the APPSC or the recruiting agency (DSC) as the case may be on humanitarian grounds. 5. Government, after careful examination of the matter and in partial modification of the orders issued in 5th read above, hereby order that conditional compassionate appointment shall be issued to the dependents (candidates) of deceased employees of subordinate offices who possess atleast Intermediate qualification to consider for the post of Jr. Assistant/Typist by giving reasonable time i.e., 5 years to acquire “Degree” qualification on par with HoDs/Directorates and Secretariat and 2 years time to qualify in the test i.e., Proficiency in Office Automation with the usage of computer and associated software conducted by the APPSC or recruiting agency (DSC) as the case may be on humanitarian grounds so as to enable the deceased family to maintain minimum status in the Society. These instructions are applicable to Subordinate Offices i.e., District and Sub District Offices. 6. All the Departments of Secretariat/Heads of Departments/District Collectors shall take necessary action accordingly. (BY ORDER AND IN THE NAME OF THE GOVERNOR OF ANDHRA PRADESH) LINGARAJ PANIGRAHI SPL. CHIEF SECRETARY TO GOVT., (GPM &AR& COOR.) & SECRETARY TO GOVERNMENT (SER. & HRM)(FAC)” 12. It is undisputed and is also evident from G.O.Ms.No.135, dated 12.05.2014, (Annexure-P5) that the qualification for the posts of Junior Assistants, Assistant-cum-Typists, Senior Stenographers and Junior Stenographers in the District Offices was enhanced from ‘Intermediate’ to ‘Degree’, (i.e., Graduation). By G.O.Ms.No.25, dated 12.03.2015, it was provided that the qualification of Intermediate for the post of Junior Assistant-cum-Typist in other than Head of Department be made applicable to those who have already submitted applications up to 11.05.2014 for appointment on compassionate ground, but the condition for appointment imposed was that such candidate would acquire the qualification required vide G.O.Ms.No.135, in 5 years time. The G.O.Ms.No.112 was issued in effect clarifying G.O.Ms.No.25, to this effect that the conditional compassionate appointment could be given to the dependant candidate who possessed at least Intermediate qualification as on 11.05.2014. It is clear that the intermediate qualification must have been passed by the candidate and the application must have been pending up to 11.05.2014. The G.O.Ms.No.112 was issued in effect clarifying G.O.Ms.No.25, to this effect that the conditional compassionate appointment could be given to the dependant candidate who possessed at least Intermediate qualification as on 11.05.2014. It is clear that the intermediate qualification must have been passed by the candidate and the application must have been pending up to 11.05.2014. The G.O.Ms.No.135, which enhanced the qualification to degree was issued on 12.05.2014 and therefore in the case of the dependant applicants who had applied up to 11.05.2014 and had acquired the qualification of Intermediate up to that date, which was the prescribed qualification for the post of Junior Assistant up to 11.05.2014, only the conditional order of compassionate appointment for the post of Junior Assistant was to be issued. 13. In the petitioner’s case, her application was submitted on 14.09.2015 i.e., after the cut of date of 11.05.2014 and she had acquired the qualification of Intermediate in April 2015 i.e., after the cut of date of 11.05.2014 as from 12.05.2014 the qualification for the post Junior Assistant became graduation. The G.O.Ms.Nos.25 & 112 shall not be applicable to her case. On the date of her appointment dated 20.09.2016, the qualification, as per G.O.Ms.No.135, was Degree for the post of Junior Assistant and consequently she was rightly appointed on the post of Subordinate for which she possessed the qualification of Intermediate and not on the post of Junior Assistant. 14. So, the submission advanced by the learned counsel for the petitioner based on G.O.Ms.No.25, dated 12.03.2015 and G.O.Ms.No.112, dated 18.08.2017 is misconceived and unsustainable. 15. The petitioner having been appointed on compassionate ground on the post of Office Subordinate, as per her qualification, and as she also having joined way back in the year 2016, cannot claim to be considered for appointment on compassionate ground again for the post of Junior Assistant after acquiring the degree qualification. 16. In State of Rajasthan v. UMRao Singh, (1994) 6 SCC 560 the candidate had accepted his appointment as Lower Division Clerk (LDC) on compassionate ground. The Hon’ble Apex Court held that having accepted the appointment as LDC, the respondent’s right to be considered for the appointment on compassionate ground was consummated. No further consideration on compassionate ground would ever arise. Otherwise, it would be a case of endless compassion. It was further held that eligibility to be appointed as Sub-Inspector of Police is one thing, the process of selection is yet another thing. 17. It is relevant to reproduce paragraphs 8 and 9 of UMRao Singh (supra) as under: “8. Admittedly the respondent's father died in harness while working as Sub-Inspector, CID (Special Branch) on 16-3-1988. The respondent filed an application on 8-4-1988 for his appointment on compassionate ground as Sub-Inspector or LDC according to the availability of vacancy. On a consideration of his plea, he was appointed to the post of LDC by order dated 14-12-1989. He accepted the appointment as LDC. Therefore, the right to be considered for the appointment on compassionate ground was consummated. No further consideration on compassionate ground would ever arise. Otherwise, it would be a case of “endless compassion”. Eligibility to be appointed as Sub-Inspector of Police is one thing, the process of selection is yet another thing. Merely because of the so-called eligibility, the learned Single Judge of the High Court was persuaded to the view that direction be issued under proviso to Rule 5 of Rules which has no application to the facts of this case. 9. Since both the sides relied on Naresh Kumar Bali's case [ (1994) 4 SCC 448 : 1994 SCC (L&S) 909 : (1994) 27 ATC 611 : JT (1994) 4 SC 184] , we will now refer to the same. We had indicated our mind in that very ruling in paragraph 15 of the said judgment. It reads as under: (SCC p. 452, para 15) “Though the respondent claimed that he had applied for the post of a teacher the Subordinate Service Selection Board had not chosen him for the post of teacher because he did not have the requisite qualification. In fact, the respondent did not object to his appointment as a clerk and his claim for consideration for the post of teacher was one year after his appointment. Thus, the appointment on compassionate ground as per the scheme had been completed.” (emphasis supplied) Therefore, once the right has consummated as we indicated earlier, any further or second consideration for a higher post on the ground of compassion would not arise.” 18. In LG. (Karmik) v. Prahalad Mani Tripathi, (2007) 6 SCC 162 the Hon’ble Apex Court held that a person cannot be appointed unless he fulfils the eligibility criteria. In that case also the respondent therein accepted the post of peon without any demur whatsoever. He, therefore, upon obtaining appointment in a lower post could not have been permitted to turn around and contend that he was entitled to a higher post although not eligible therefor. 19. It is apt to refer paragraph-12 in LG. (Karmik) (supra) as under: “12. Furthermore, the respondent accepted the said post without any demur whatsoever. He, therefore, upon obtaining appointment in a lower post could not have been permitted to turn round and contend that he was entitled for a higher post although not eligible therefor. A person cannot be appointed unless he fulfils the eligibility criteria. Physical fitness being an essential eligibility criteria, the Superintendent of Police could not have made any recommendation in violation of the rules. Nothing has been shown before us that even the petitioner came within the purview of any provisions containing grant of relaxation of such qualification. Whenever, a person invokes such a provision, it would be for him to show that the authority is vested with such a power.” 20. As held above, the petitioner had accepted her appointment on the post of Office Subordinate for which she possessed the qualification. She was also not entitled for appointment on the post of Junior Assistant, as she had not completed the Intermediate before the amendment in the rules enhancing the qualification as Degree (Graduation) for the post of Junior Assistant. 21. I do not find any illegality calling for interference with the order dated 03.01.2022 passed by the Chief Executive Officer. 22. The writ petition lacks merit and is dismissed. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed in consequence.
