JUDGMENT: D.V.S.S.SOMAYAJULU, J. Heard learned Government Pleader for Services-I. 2. The apprehension expressed by the learned Government Pleader that the prima facie opinion expressed by the learned Single Judge will be against him is unwarranted. 3. In the opinion of this Court it is a mere observation and not a finding on merits. The writ petition has become infructuous as per the learned senior counsel, but the learned Government Pleader disagrees. This Writ Appeal is remanded back to the learned Single Judge to decide the writ petition on its own merits including the question whether the cause survives, by setting aside the impugned order. 4. Accordingly, the Writ Appeal is allowed. There shall be no order as to costs. As a sequel, Miscellaneous Applications, if any, pending shall also stand closed.
