JUDGMENT Dr. V R K Krupa Sagar, J. - The learned counsel for the petitioner and the learned Additional Public Prosecutor are present and submitted arguments. In Crl.M.P.No.4161 of 2022, by an Order dated 10.11.2022, passed by learned Special Judge for trial of offences under NDPS Act-cum-Metropolitan Sessions Judge, Visakhapatnam, granted bail to this petitioner, in terms of Section 167 (2) of Cr.P.C., since he has been in Judicial remand from 21.04.2022. 2. While granting bail, the following conditions were stipulated: 'The petitioner/A1 is enlarged on bail on his furnishing Bond for Rs.2,00,000/- (Rupees two lakhs only) with two sureties for like sum each to the satisfaction of Special Judicial First Class Magistrate for Excise, Visakhapatnam and on condition, directing the petitioner/A1 shall appear before the SEB Station, Visakhapatnam-II on every Fourth Saturday of the month in between 10.00 A.M. to 5.00 P.M and give his attendance till filing of the charge sheet. This Court further directed the petitioner/A1 to co-operate with the investigation agency where and when his presence is required for smooth functioning of the investigation. He is further directed not to abscond and attend the court regularly without fail and also that he should not involve in the similar offences. If the petitioner/A1 violates any of the above condition, the bail stands cancelled.' 3. In the present petition, the submission is that petitioner is a poor daily wage labour, working in Visakhapatnam District, though, he belongs to Kerala State. This impecuniousness resulted in onerous condition being not complied with. Therefore, seeks for modification of the conditions. 4. Considering the material on record and the submissions on both sides, the personal bond and the bond to be executed by both the sureties as prescribed by the trial Court at Rs.2,00,000/- is modified and substituted by Rs.20,000/- (Rupees Twenty thosand only). Rest of the bail conditions stand intact. 5. Accordingly, this Criminal Petition is allowed.
