ORDER : 1. The petitioner in W.P. No. 123 of 2023 has approached this Court being aggrieved by the opening of rowdy sheet/suspect sheet bearing C. No. 722/GL-SDOG/2019 dated 04.12.2019 issued by the Sub-Divisional Police Officer, Gudur. 2. The petitioner in W.P. No. 127 of 2023 has approached this Court being aggrieved by the opening of rowdy sheet/suspect sheet bearing C. No. 722/GL-SDOG/2019 dated 04.12.2019 issued by the Sub- Divisional Police Officer, Gudur. 3. In both the proceedings the Sub-Divisional Police Officer had granted permission to open suspect sheets against the petitioners on the ground that both the petitioners were involved in Crime No. 105 of 2019 registered with the Gudur I Town Police Station for the offences punishable under Sections 272, 273, 328, 188 IPC and Section 59 (1) of the Food Safety and Standards Act, 2006. 4. This Court by order dated 23.07.2019 in Crl. Pet. No. 4311 of 2019 had quashed the said complaint on the ground that sale of tobacco products would not attract the provisions of Sections 272, 273, 328, 188 IPC and Section 59 (1) of the Food Safety and Standards Act, 2006. 5. In view of the fact that the said complaint itself had been quashed by this Court the question of rowdy sheets/suspect sheets being maintained on the basis of the involvement of the petitioners in a crime, would not arise. 6. Accordingly, these writ petitions are allowed setting aside the impugned proceedings of the Sub-Divisional Police Officer, Gudur, who is arrayed as the 4th respondent herein, bearing C. No. 722/GL-SDOG/2019 dated 04.12.2019 are set aside and any rowdy sheet/suspect sheet opened on that basis against the petitioners shall also stand closed. There shall be no order as to costs. 7. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
