JUDGMENT Milind Ramesh Phadke, J. - The matter pertains to medical termination of the pregnancy which is a cause of concern for the present petitioner whose daughter aged about seventeen years and seven months and was subjected to sexual harassment, due to which, she became pregnant. 2. As per the averments made in the Writ Petition on 13/12/2022 a report under Section 363 IPC was registered against one Girraj Goli for alleged kidnapping of daughter of petitioner and during investigation when the girl was recovered, she was sent for her medical examination and in the report, it has been opined by the Doctor that she is pregnant by seven weeks and six days. Since, it is a case of sexual harassment of a minor and the petitioner wants to get the pregnancy terminated, therefore, CMHO, Gwalior is directed to constitute a Medical Board with experts in the field concerned and opinion be sought from the Medical Board with regard to the medical termination of pregnancy. 3. Shri Khot who appears on advance notice is directed to call for the case diary as well as communicate this order to the concerned CMHO, Gwalior. 4. The CMHO, Gwalior is directed to constitute the said Medical Board within a period of three days and submit his report latest by 30th of January, 2023. 5. It has been informed by Counsel for the petitioner that the girl at present is in the safe custody of Child Welfare Committee, Gwalior. 6. In the light of the aforesaid, Station House Officer, Police Station, Dabra, Gwalior is directed to make the girl remain present before the Medical Board on 27th of January, 2023. 7. Let the aforesaid exercise be completed as per the aforementioned schedule. 8. List the case on 30th of January, 2023.
