ORDER : Rajesh Shankar, J. Learned counsel for the petitioner prays for and is allowed to replace the respondent no. 2 as District Supply Officer, Garhwa. 2. Necessary replacement/correction be made by the counsel for the petitioner in course of day. 3. The present writ petition has been filed for issuance of direction upon the concerned respondents-respondent no. 3 to forthwith restore the original strength of card holders attached to the petitioner's PDS shop, having licence no. 39 of 1994 4. Learned counsel for the petitioner submits that the petitioner was granted PDS Licence no. 39 of 1994 for village Harhe, district Garhwa, wherein 515 card holders were attached. The aforesaid PDS licence of the petitioner was, however, suspended by the respondent no. 2 vide order as contained in memo no. 1741 dated 7th November, 2020, attaching the card holders to “Priyanka Mahila Group”, having Licence no. 58 of 2009. Subsequently, vide order as contained in memo no. 74 dated 20th January, 2021, the respondent no. 2 revoked the order of suspension with a warning to the petitioner. Thereafter, the petitioner represented the respondent no. 2 on 14th September, 2021 for restoration of all the card holders who were attached to his PDS shop before the order of suspension was passed. It is further submitted that pursuant to the said representation, the respondent no. 2 vide letter no. 1275 dated 25th September, 2021 directed the Block Supply Officer, Ramkanda-respondent no. 4 to submit a report in that regard. However, as per the petitioner's information, no such report has been submitted by the respondent no. 4 and, therefore, the respondent no. 2 has not taken decision on his representation. 5. Mr. Rishi Chandan, learned A.C. to S.C.V appearing on behalf of the respondents submits that if no decision in this regard has yet been taken by the respondent no. 2, he will expedite the matter and will take appropriate decision within a time frame. 6. Having heard learned counsel for the parties and keeping in view the submission of the learned counsel for the petitioner that the respondent no. 4 has not yet submitted report in terms with the direction of the respondent no. 2 given to him vide letter no. 1275 dated 25th September, 2021, the respondent no. 2 is directed to obtain the said report from the respondent no.
