JUDGMENT Prasanna B. Varale, CJ. - The writ appeal as well as the contempt petition are taken up for hearing, with the consent of the learned counsel for the parties. 2. Heard the learned counsels at length. 3. W.A.No.57/2023 is partly allowed. The order dated 22.09.2022 passed by the learned Single Judge in W.P.No.18832/2022 is set aside. Further, the order dated 14.12.2022 passed by the learned Single Judge in Review Petition No.814/2022 is as well set-aside. Writ Petition No.18832/2022 is restored to file. The said matter is remitted back to the learned Single Judge for a decision afresh, after hearing the learned counsel for the parties. Considering the urgency in the matter, as the examinations are scheduled to commence from 03.02.2023 onwards, the learned Single Judge is requested to decide the petition afresh, by giving an opportunity of hearing to the parties. We request the learned Single Judge to hear the parties on 30.01.2023 and to preferably decide the petition afresh, on or before 01.02.2023. 4. In view of the disposal of the appeal and remitting the matter back to the learned Single Judge for decision afresh, the contempt petition no more survives for consideration. The contempt petition is also disposed of accordingly. 5. Registrar (Judicial) is directed to place the matter before the Learned Single Judge having the roster, on 30.01.2023.
