JUDGMENT Ravindra Maithani, J. - Applicant Shamim Ahmed @ Kaala is in judicial custody in FIR No.318 of 2019, under Sections 2 and 3 of the UP Gangster and Anti Social Activities (Prevention) Act, 1986, Police Station Kashipur, District- Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. It is argued by learned counsel for the applicant that the applicant is already on bail in all cases, based on which the instant case has been lodged against him; the applicant is not a previous convict. 4. This fact is admitted to learned State Counsel. 5. In fact, the basis of the instant FIR is some cases pertaining to theft. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
