ORDER : Issue notice to the respondents. 2. On asking of the court, Mr. Punit Singhvi, Advocate accepts notice on behalf of respondent No.1 and Mr. Sameer Sharma appearing on behalf of Dr. Ganesh Parihar, AAG accepts notice on behalf of respondent No.2. 3. Learned counsel for the petitioner submits that the petitioner is unable to avail of the remedy before the Appellate Tribunal because of non-constitution thereof and he would make the payment as per the provisions as contained in Section 112 of sub-section (8) of the Central Goods and Services Tax Act, 2017 (for short 'the Act of 2017'). On deposit of the said amount as specified in sub section (8), the recovery proceedings for the balance amount shall be deemed to be stayed till the disposal of the appeal. 4. Accordingly, it is directed that till the next date of hearing, subject to deposit of the amount by the petitioner under Section 112 of sub-section (8), the recovery proceedings for the balance amount of the disputed amount shall be deemed to be stayed till the next date of hearing. 5. List on 08.09.2023 alongwith D.B. Civil Writ Petition 17859/2022. 6. Name of Mr. Punit Singhvi and Dr. Ganesh Parihar, AAG be mentioned in the cause list as counsel for respondent Nos. 1 & 2 respectively.
