JUDGMENT Alok Kumar Verma, J. - Mr. Mohit Kumar, learned counsel for the petitioner, submitted that the petitioner was an accused in Case Crime No.4 of 2011, registered with Police Station Kotwali Manglour, District Haridwar. The bail application of the petitioner was rejected. He had moved a Bail Application (No.306 of 2011) before this High Court, and, on 25.04.2011, bail was granted by this Court on the condition of depositing Rs.25,000/- and furnishing two sureties. The petitioner had deposited Rs.25,000/- before the concerned Court and also furnished two sureties. The trial was concluded and the petitioner was acquitted on 11.07.2022. The petitioner moved an application for release of Rs.25,000/-, deposited by him. The said Miscellaneous Case No.29 of 2022 is pending before the Court of Judicial Magistrate/Civil Judge, (Junior Division), Roorkee, District Haridwar. 2. The present writ petition has been filed with the following relief:- Issue a writ, order or direction directing the court below to decide/expedite the Misc. Case No.29 of 2022 pending in the court of Civil Judge (J.D.)/Judicial Magistrate Roorkee, District Haridwar and/or to direct the court below to release Rs.25,000/- deposited by the petitioner at the time of being release on bail by the order of Hon'ble High Court. 3. Having heard the learned counsel for the parties and in the facts and circumstances of the case, the Court concerned is hereby directed to expedite the proceedings of the said Miscellaneous Case No.29 of 2022 and to decide the said case expeditiously, preferably within a period of one month from the date of receipt of the certified copy of this order, in accordance with law. 4. The present Writ Petition (M/S) No.323 of 2023 stands disposed of accordingly.
