DEEPAK GUPTA, J. 1. Fresh power of attorney has been filed on behalf of the petitioner. 2. Petitioner prays for grant of regular bail in case FIR No.580, dated 30.10.2020, registered at Police Station Sadar Thanesar, District Kurukshetra, under Sections 15, 20 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ( Section 27A of NDPS Act added later on). 3. 10 quintals, 37 Kgs. of poppy husk and 34 Kgs. of Ganja is alleged to have been recovered from the possession of co-accused Roshan Lal, Firoz Khan and Sandeep, who in their respective disclosure statements named one Sujjan Singh @ Sunny to be the supplier of the contraband. Name of the petitioner Rinku Ram emerged in the disclosure statement of co-accused Roshan Lal, as per which petitioner was employed by him and he used to sell the contraband to the drivers visiting the Dhaba of said Roshan Lal. 4. Status report by way of affidavit of Shri Ram Dutt, Deputy Superintendent of Police, Kurukshetra, is filed. It is conceded that no recovery was effected from the possession of the petitioner, pursuant to the disclosure statement. As per custody certificate placed on record, petitioner is in custody in this case for the last 10 months and 17 days, although he was involved in one more case, i.e. under Section 174-A IPC, in which he has already been sentenced for the period already undergone by him. 5. Having regard to the fact that no recovery was effected from the petitioner and his name has emerged on the basis of disclosure statement only, but without commenting anything further on the merits of the case, petitioner is admitted to bail and he is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of learned Trial Court concerned. 6. Allowed. Petition allowed.
