ORDER : 1. The petitioners have been filed the present bail application under Section 438 Cr.P.C. against the FIR No. 220/2022 of Police Station Osia, Distt. Jodhpur for the offence punishable under Sections 420 and 120B of IPC. 2. Learned counsel for the petitioners submits that according to the complaint filed against the petitioners is vague in as much as the complainant has not mentioned that on which date the amount was paid to the complainant. It is further stated that at the most it is a case of breach of contract and which is of civil nature. He further submits that so far as petitioner No. 2 Hitesh is concern, no allegation has been made in the complaint. Therefore, anticipatory bail may kindly be allowed. 3. Learned Public Prosecutor and counsel for the complainant vehemently opposed the bail application. 4. I have considered the arguments advanced before me and carefully gone through the material available on record. 5. According to the statement of complainant Smt. Rama recorded under Section 161 Cr.P.C., a specific allegation has been levelled against both the accused that they entered in agreement to sale with the complainant and received Rs.80 Lacs from the complainant. Thereafter neither the registration was done nor the money was returned to the complainant. Likewise, other witnesses were also support the version of complainant Smt. Rama. Therefore at this stage, no case for grant of anticipatory bail is made out. 6. Hence, the present bail application is hereby dismissed.
