JUDGMENT : SUVIR SEHGAL, J. 1. This is the 1st petition filed by petitioner under Section 438 of Cr.P.C. for grant of anticipatory bail in: FIR No. Date Police Station Section 623 26.12.2022 Pundri, District Kaithal 409 of IPC, 1860 2. At the outset, counsel for the petitioner submits that the petitioner has joined the investigation and co-operated with the investigation. He submits that the petitioner is named as an accused in another FIR bearing No. 115 dated 14.03.2021 lodged for offences under Sections 406 and 420 of IPC at Police Station Pundri, District Kaithal and he has been released on anticipatory bail by this Court vide order dated 21.01.2022, Annexure P-4. 3. Upon instructions, State Counsel affirms that the petitioner has joined the investigation in compliance of order dated 17.04.2023 passed by this Court and that he has co-operated with investigation. He submits that the petitioner is not co-operating as money has not recovered. 4. Heard counsel for the parties. 5. Merely because the money allegedly swindled by the petitioner from the accused has not been recovered, will not be a ground to deny confirmation of the interim bail order passed in favour of the petitioner. 6. Without commenting upon the allegations levelled in the petition, present petition is allowed and order dated 17.04.2023 granting interim bail to the petitioner is made absolute, subject to the satisfaction of the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
