JUDGMENT Saurabh Lavania, J. Heard learned counsel for the petitioners and Shri Hemant Kumar Pandey, learned Standing Counsel for State-respondents. 2. By means of the present petition, the petitioners have assailed the order dated 06.10.2022 (Annexure No. 1 to the petition) passed by respondent no.2/Deputy Director of Consolidation/Additional District Magistrate (F/R), Lakhimpur-Kheri (in short "DDC")in Revision No. 459/202254104300001451 (Rameshwari Gupta v. State of U.P. and Others) which was preferred under Section 48(1) of U.P. Consolidation of Holdings Act, 1953 (in short "Act, 1953"). 3. The revision, indicated above, was filed by opposite party no.6/ Rameshwari Gupta assailing the order dated 10.06.2022 (Annexure No. 8 to the petition) passed by respondent no.3/Settlement Officer of Consolidation (in short "SOC") in Appeal No. 495/2020541043000266 (Rameshwari Gupta v. State of U.P. and Others) which was preferred under Section 11(1) of Act, 1953 and also the order dated 31.08.2020 (Annexure No. 6 to the petition) passed by respondent no.4/Consolidation Officer concerned (in short "CO") in Case No(s). 244/19-20 (Rameshwar Gupta v. Pramodgiri) and 838/19-20 (Vinod Kediya v. Pramodgiri). 4. Vide order dated 31.08.2020, the C.O. dismissed the objection/claim of the opposite party no. 6/Rameshwari Gupta which was based upon the registered sale deed dated 28.02.2018 (Annexure No. 2 to the petition) and allowed the objection of Vivek Kediya, who preferred the objection in public interest, after observing that land, in issue, i.e. Gata No. 19 situated at Village Kunautiya, Pargana-Pehla, Tehsil- Lakhimpur, District- Kheri was acquired for national highway. 5. Being aggrieved, the opposite party no. 6/Rameshwari Gupta, who purchased the land from one Pramod Giri, son of original tenure holder Shri Krishna, preferred an Appeal No. 495/2020541043000266. In the appeal, the petitioners were not impleaded, therefore, an application for impleadment was preferred and they were impleaded in compliance of order dated 08.09.2021 (Annexure No. 9 to the petition) and after hearing to the parties in the proceedings, the appeal was dismissed vide order dated 10.06.2022 affirming the order dated 31.08.2020. 6. Thereafter, opposite party no.6/Rameshwari Gupta preferred the Revision No. 459/202254104300001451 before respondent no.2. In the revision, petitioners were not impleaded. However, necessary party-the State as also the concerned department i.e. Public Works Department, Division-1, Lakhimpur Kheri (in short "P.W.D.") were impleaded. It would be relevant to refer that neither State Government nor P.W.D. contested the case before the authorities under Act, 1953 including before the DDC. 7.
In the revision, petitioners were not impleaded. However, necessary party-the State as also the concerned department i.e. Public Works Department, Division-1, Lakhimpur Kheri (in short "P.W.D.") were impleaded. It would be relevant to refer that neither State Government nor P.W.D. contested the case before the authorities under Act, 1953 including before the DDC. 7. It would be apt to refer that petitioners are not aggrieved party but as per their own case, they are only whistle-blower. It would be relevant to refer that consolidation authorities under the Act, 1953 are not supposed to entertain an objection/appeal of a person who is not an aggrieve party. 8. The Revisional Authority/DDC, vide impugned order dated 06.10.2022, reversed the concurrent findings of fact recorded by the CO and SOC and allowed the revision of opposite party no.6/Rameshwari Gupta.
It would be relevant to refer that consolidation authorities under the Act, 1953 are not supposed to entertain an objection/appeal of a person who is not an aggrieve party. 8. The Revisional Authority/DDC, vide impugned order dated 06.10.2022, reversed the concurrent findings of fact recorded by the CO and SOC and allowed the revision of opposite party no.6/Rameshwari Gupta. While assailing the order impugned, learned counsel for the petitioners submitted as under: (i) Petitioners were not impleaded in the revision, as such the order impugned is liable to be interfered with by this Court only on the ground of non-impleadment of necessary parties. (ii) The land, in issue, was acquired for National Highway and accordingly the registered sale deed dated 28.02.2018 executed by Pramodgiri, son of original tenure holder namely Shri Krishna, in favour of opposite party no.6/Rameshwari Gupta, who filed the revision, was itself void and as such, no right can be granted on the basis of void registered sale deed to opposite party no.6/Rameshwari Gupta. (iii) The respondent no.2 has validated the void registered sale deed by virtue of order impugned though the validity of a sale deed can only be looked into by the competent Court of jurisdiction. 10. Considered the aforesaid and perused the record including the impugned order. 11. Facts based upon the documents, which were considered by DDC and are relevant for the disposal of the present petition, are as under: i. On 22.03.1965 i.e. in fasli year 1372, the possession of land acquired for road was taken. ii. In khatauni of fasli year 1371-73, Gata(s) No. 1/15 to 1/22/area 5.75 hectare in khata no. 29 were recorded in the name of Krishna Giri (father of Pramod Giri, who executed the sale deed in favour of opposite party no. 6/Rameshwari Gupta). iii. The order dated 24.12.1965 passed by Assistant Consolidation Officer in Case No. 65, during first consolidation operation, related to Khata No. 29, indicates Gata(s) No. 1/3/1/0.60 and 1/3/4.22. Thus, DDC, in the impugned order dated 06.10.2022, opined that there is shortage of 0.93 hectares land. iv. Gata(s) No. 1M/.40, 1M/0.17, 13/1/0.08, 79/2/0.19, 108/2/0.18 and 111/0.01 belonging to Krishna Giri (father of Pramod Giri, who executed the sale deed in favour of opposite party no. 6/Rameshwari Gupta) were acquired, as per report of lekhpal. v. From Khata No. 29, Gata No 1M, which was in the name of Krishna Giri (father of Pramod Giri, who executed the sale deed in favour of opposite party no. 6/Rameshwari Gupta), only 0.40 hectare of land was acquired. vi. On 22.03.1965, the possession of acquired land of Krishna Giri (father of Pramod Giri, who executed the sale deed in favour of opposite party no.
6/Rameshwari Gupta), only 0.40 hectare of land was acquired. vi. On 22.03.1965, the possession of acquired land of Krishna Giri (father of Pramod Giri, who executed the sale deed in favour of opposite party no. 6/Rameshwari Gupta) was taken acquired and thereafter, the Assistant Consolidation Officer passed the order on 24.12.1965 and according to this order in the revenue record his remaining land was recorded as Gata(s) No. 1/3/1/0.60 and 1/3/4.22. vii. Form -41, indicates new number of Gata No. 1/3/1 as Gata No. 19. viii. Form-45 indicates, Khata No. 25 and Gata No. 19/0.60 hectares. ix. Form-2A indicates, road adjacent to Gata No. 1/3/1/0.60 hectares. x. Demarcation report dated 09.02.2013 and order dated 30.03.2013 passed by Pargana Adhikari, Kheri, indicates that land i.e. Gata no. 19 was not acquired. 12. On the issue of acquisition of land after considering the aforesaid facts, the DDC recorded a specific finding that Gata No. 19 (Old Gata No. 1/3/1) was never acquired. 13. On being asked on the aforesaid finding, the learned counsel for the petitioners, on the basis of relevant material evidence including the notifications issued for acquisition of land, though it is the duty of the petitioners to challenge the findings based upon some material evidence, failed to satisfy this Court that the finding aforesaid is a perverse finding. 14. In view of above as also that aforesaid indicates that land i.e. Gata No. 19 was never acquired, this Court is of the view that the finding pertaining to acquisition of land given by respondent no. 2 in the order impugned, according to which, the land, in issue, i.e. Gata No. 19 (Old Gata No. 1/3/1) was never acquired, is justified. 15. In regard to submissions of learned counsel for the petitioners that the DDC has no power to adjudicate upon the issue related to sale deed, this Court finds that the findings recorded by respondent no. 2 are based upon the fact that land was not acquired, as such this finding is also justified. 16.

With regard to non-impleadment of petitioners, this Court is of the view that the petitioners were not necessary parties and necessary parties i.e. State and Public Works Department concerned were impleaded as according to the case of the petitioners the land was acquired though the finding is otherwise and this Court has also recorded a finding that finding recorded by DDC regarding acquisition of land i.e. Gata no. 19 is perfectly justified. 17. Before this Court, the State Government/P.W.D. has not come forward to show that the land, in issue, purchased by respondent no. 6/Rameshwari Gupta by virtue of registered sale deed dated 28.02.2018 was actually acquired for National Highway. 18. Accordingly, for the reasons aforesaid, this petition has no merits and is accordingly dismissed. However, dismissal of this petition would not prejudice the rights of State/P.W.D. if the concerned., being aggrieved, challenges the impugned order dated 06.10.2022 before this Court or any other forum. No order as to costs.
