ORDER : Mr. Sudesh Bansal, J. - These bail applications have been filed by petitioners under Section 439 Cr.P.C. in connection with FIR No.350/2023 registered at Police Station Galta Gate, District Jaipur for offence(s) under Sections 323, 341, 392, 308 read with 34 and 120B of IPC and Section 4/25 of the Arms Act. 2. Counsel for petitioners submits that investigation in the FIR has been completed and charge-sheet has been filed, the co-accused Irfan Qureshi @ Jhingar has been released on bail by the Co-ordinate Bench vide order dated 01.11.2023 in S.B. Criminal Misc. Bail Application No. 13246/2023, offences are triable by the Magistrate and the conclusion of trial will take considerable time, therefore, petitioners be released on bail. 3. Learned Public Prosecutor and counsel for complainant have opposed the bail application and pointed out that the case of petitioners are wholly different from the co-accused Irfan Qureshi @ Jhingar. Petitioners namely Kasim @ Pav, Afsar @ Aadha Kilo and Nijamuddin @ Bablu Merathiya are named in the FIR and against all three petitioners, there are several previous cases are pending. 4. After arguing for some time counsel for petitioners do not press bail applications at this stage and seeks permission to withdraw the same with liberty to file afresh before the trial Court after recording statements of complainant. 5. Accordingly, bail applications are dismissed as withdrawn with liberty as prayed for. 6. However, it is expected from the trial Court to record statements of complainant on priority basis or as early as possible.
