JUDGMENT (Prayer: First Appeal as against the judgment and decree dated 07.09.2019 made in O.S. No. 25 of 2015 on the file of the Principal District Judge, Tiruvannamalai. S. Vaidyanathan. 1. The appeal suit is preferred as against the judgment and decree dated 07.09.2019 passed in O.S. No. 25 of 2015 by the learned Principal District Judge, Tiruvannamalai. 2. Though after detailed arguments, orders were reserved at the condone delay stage, on mention made by the parties that they have arrived at a settlement, the matter was listed and after condonation of delay and numbering of the appeal suit, the appeal suit is taken up for disposal. 3. Parties have arrived at a compromise and a joint memo of compromise dated 11.07.2023 duly signed by the respective parties and countersigned by their counsel has been filed evidencing complete settlement. Though the memo of compromise has been filed in the C.M.P. to condone delay, it is submitted that the same may be recorded in the appeal suit. Accordingly, the appeal suit stands disposed of in terms of the memo of compromise. 4. The memo of compromise shall form part of the decree. Refund of court-fee shall be as permissible under the Rules. No costs. Connected C.M.P. is closed.
