JUDGMENT Alok Kumar Verma, J. - The present Appeal has been filed by the Insurance Company under Section 173 of the Motor Vehicles Act, 1988 against the Award dated 31.07.2014, passed by learned Motor Accident Claims Tribunal/1st Additional District Judge, Nainital in Motor Accident Claim Petition No. 54 of 2013, 'Smt. Savitri Devi and Others vs. Prem Singh Nagarkoti and Others', by which, the Tribunal has awarded a total sum of Rs. 40,76,480/- (Rupees Fourty Lakh Seventy Six Thousand Four Hundred Eighty) as compensation along with an interest @ 7.5 % per annum from the date of petition till its actual payment. 2. Heard Mr. Prabhat Pande, learned counsel for the appellant and Mr. Ayush Agrawal, learned counsel holding brief of Mr. Akhil Kumar Sah, learned counsel for the respondent nos. 1 to 3-claimants. 3. Learned counsel for the Insurance Company-appellant submitted that the appellant is ready to pay Rs. 39,50,000/- (Rupees Thirty Nine Lakh Fifty Thousand) as compensation along with an interest @ 7.5 % from the date of petition till its actual payment. 4. Learned counsel appearing for the respondent nos. 1 to 3-claimants is agree. 5. Both the parties have filed a Miscellaneous Application (MCC No. 12670 of 2023). According to the said application, both the parties are agree as above. Therefore, the present Appeal is being decided on the said compromise. The said Miscellaneous Application (MCC No. 12670 of 2023) will be part of this order.
