JUDGMENT : [Manish Mathur, J.] 1. Heard learned counsel for the petitioners and learned State Counsel appearing for opposite parties. 2. Present petition has been filed seeking direction to opposite parties to decide representation of petitioners dated 04.07.2022 with regard to payment of remaining gratuity. 3. Learned counsel for petitioners submits that petitioners were appointed in years 1989 on the post of Part-time Tubewell Operators and were subsequently regularized in year 2008 whereafter they have superannuated from service. It is submitted that although some gratuity was paid to them upon superannuation but is not in accordance with the Payment of Gratuity Act, 1972. As such, prayer has been made for payment of gratuity along with interest. 4. Learned counsel for petitioners restricts prayer for decision on representation of petitioners. 5. Considering the submissions advanced by learned counsel for parties and without entering into merits of the case, opposite party no.3, i.e. Executive Engineer, Nalkoop Khand 1st, District Moradabad is directed to consider and decide representation dated 04.07.2022 preferred by petitioners expeditiously, within a period of six weeks from the date a copy of this order is produced before the authority concerned. 6. In view of aforesaid, the petition stands finally disposed of.
