JUDGMENT V. Kameswar Rao, J. (Oral) CM APPL. 24162/2023 & 24163/2023 1. Exemptions allowed, subject to all just exceptions. 2. Applications stand disposed of. W.P.(C) 6132/2023 3. The challenge in this petition is to an order dated April 17, 2023, passed by Central Administrative Tribunal (`Tribunal', in short) in O.A. No.2556/2021, whereby the Tribunal adjourned the petition to May 16, 2023 at 2:30 PM. 4. Mr. Gautam Narayan states this is the second round of litigation. The initial one being W.P.(C) 13688/2022, decided on September 21, 2022, whereby this Court had in para 10 stated as under: "10. Keeping in view the fact that the Original Application had been adjourned to 19.10.2022, we dispose of this petition along with pending application, requesting the Tribunal to dispose of the Original Application on 19.10.2022 or soon thereafter as may be possible." 5. We have been told that on March 27, 2023, the matter has been heard for some time. Mr. Gautam Narayan clarifies that Mr. Joby P. Varghese counsel for the petitioner has concluded his arguments. Mr. Chetan Sharma, learned ASG agrees with the submission made by Mr. Gautam Narayan. 6. Mr. Gautam Narayan and Mr. Chetan Sharma state, appropriate shall be that the Bench which had heard the matter partly on March 27, 2023, hears the Original Application on the date fixed, i.e. May 16, 2023. 7. If that be so, the Bench which had heard the matter on March 27, 2023, shall hear the matter on May 16, 2023. Counsel for the parties state they shall endeavour to complete the arguments on that date. 8. Mr. Gautam Narayan and Mr. Chetan Sharma states with the above, the petition be disposed of. It is ordered accordingly.
