JUDGMENT : [Manish Mathur, J.] 1. Heard learned counsel for petitioner. In view of order being passed, notices to opposite parties stand dispensed with. 2. Petition has been filed under Article 227 of the Constitution of India seeking a direction to court concerned for expeditious disposal of Suit for permanent injunction filed by opposite party no.2 in which petitioner is defendant. 3. Learned counsel for petitioner submits that aforesaid Suit had been filed by opposite party no.2 registered as Regular Suit No.848 of 2016. It is submitted that petitioner as well had filed Cross Objection. It is submitted that case as of now is pending at the stage of leading of evidence. 4. Considering the submissions advanced by learned counsel for petitioner and upon perusal of material on record, it appears that Regular Suit No.848 of 2016 filed by opposite party no.2 is pending since year 2016 and is at the stage of leading of evidence. As such, Civil Judge (Senior Division)/A.C.J.M. Bahraich is directed to decide Regular Suit No.848 of 2016 (Rakesh Kumar v. Murli Matanheliya and others) and the cross objection pending therein expeditiously, without granting any undue adjournments to either parties in case there is no other legal impediment. 5. Benefit of this order shall be available to petitioner only in case he cooperates in early disposal of the proceedings. 6. Petitioner is granted liberty to approach this Court again in case the proceedings could not be decided within a period of one year from the date a certified copy of this order is brought on record of the proceedings, With aforesaid observations, the writ petition stands disposed of.
