JUDGMENT : [Manish Mathur, J.] 1. Heard learned counsel for petitioner. In view of order being passed, notices to opposite parties stand dispensed with. 2. Petition has been filed under Article 227 of the Constitution of India seeking a direction to court concerned for expeditious disposal of Appeal/Misc. Case No.05 of 2018 in which respondents have already appeared and also said to have filed their objections. 3. Learned counsel for petitioner submits that proceedings arise out of mutation in which inadvertently petitioner's name has been left out which led to filing of aforesaid appeal which is pending ever since, despite respondents having put in appearance. 4. Considering the submissions advanced by learned counsel for petitioner and upon perusal of material on record, Small Causes Court, Faizabad is directed to expedite proceedings in Appeal/Misc. Case No.05 of 2018 (Dilshad Hussain v. Nagar Ayukt, Nagar Nigam Ayodhya and others) and conclude the same, preferably within a period of six months from the date a copy of this order is brought on record of the proceedings, without granting any undue adjournments to either parties in case there is no other legal impediment. 5. Benefit of this order shall be available to petitioner only in case he cooperates in early disposal of the proceedings. With aforesaid observations, the writ petition stands disposed of.
