JUDGMENT (Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 2nd respondent to provide adequate police protection for petitioner''s life and limb as well as to consummate the marriage scheduled to be held on 17.09.2023 at Mariamman Temple, Chithira Seelamanaickanur, Edaiyapatti Post, Kadavur Taluk, Karur District by considering the representations given by the petitioner dated 09.09.2023 and 10.09.2023.) 1. This Writ Petition is filed under Article 226 of the Constitution of India seeking for a mandamus to the respondent Police to dispose of the representations given by the petitioner, dated 09.09.2023 and 10.09.2023, alleging that the rival parties in the village have been practising excommunication and not permitting the petitioner to perform the marriage of the petitioner’s son to be held on 17.09.2023 at Mariamman Temple, Chithira Seelamanaickanur, Edaiyapatti Post, Kadavur Taluk, Karur District. 2. It is submitted by learned counsel for the petitioner that since the petitioner’s son is going to marry inter sect marriage, the other villagers and the caste people have been prohibiting the petitioner to perform the marriage in the Mariamman Temple, wherein, the persons of the caste people will perform the marriage. Therefore, sought for suitable directions. 3. Learned Government Advocate (Criminal Side) on the other hand submits that the respondent Police made an enquiry basing on the representations given by the petitioner, wherein, the petitioner and others were present and a resolution was passed, wherein, the petitioner has agreed to perform the marriage of the petitioner’s son at a place situated near the petitioner’s house. Learned Government Advocate (Criminal Side) has also shown the copy of the said resolution signed by the petitioner to the learned counsel for the petitioner as well as before this Court. 4. Now, the learned counsel for the petitioner further submits that, on that date, the petitioner being an illiterate though did not specifically say that he would perform the marriage of his son at the place near to his house and submitted that, he intends to perform his son’s marriage near the temple where everybody in the village will perform. 5. Learned Government Advocate (Criminal Side) reported that if the petitioner intends to perform the marriage near the temple, the respondent Police would provide necessary protection and the same is recorded. 6.

Considering the circumstances, the petitioner is at liberty to perform the marriage near the Temple and in case, if necessity, the respondent Police are directed to give necessary protection. 7. With the above direction, the Writ Petition is disposed of. No costs.
