JUDGMENT : The petitioners seeks mandamus directing the respondents not to demolish any portion of the buildings of the petitioners, which is situated at Village Rajpur, Tehsil Jaspur, District Udham Singh Nagar at Khasra No.308 min in area of measuring 0.0650 hectare (“the property”). 2. Heard learned counsel for the parties and perused the record. 3. Learned Senior Counsel appearing for the petitioners would submit that they are the owners in possession of the property. They have constructed dwelling house, but suddenly, yesterday a cross-mark was levelled on the property by the respondent-authorities for demolition and removal of it. It is argued that the petitioners have not been given any notice. The petitioners are owners and in possession of the property. It was gifted to the petitioners by their father, who was owner of the property. 4. At the very outset learned Chief Standing Counsel would submit that even no notice was issued to the petitioners. The petition is pre-matured. It has been filed merely on apprehension. He would refer to para no.9 of the petition, which reads, “That the respondents abruptly under the garb of political pressure are trying to demolish some portion of the ” 5. Learned Chief Standing Counsel gives a statement that the mark may be placed to identify the property so that it may be examined as to whether it is an encroachment or not. He gives a statement that before any action is taken, petitioners would be served with a notice. They would be afforded an opportunity of hearing and order would be passed in accordance with law. 6. Learned Senior Counsel still raises an apprehension that the respondent-authorities may without considering the objections may pass the order. He would request that the respondent-authorities may further be directed that they should pass a reasoned order and should serve it to the petitioners so that, if there is any remedy available under the law, that may be availed by the petitioners. 7. The Court takes on record the statement given by the Chief Standing Counsel. 8. If any action is required to be taken against the petitioners, it should be taken in accordance with law. The petitioners should be given an opportunity of hearing and after hearing a speaking order has to be passed. Such order must be served on the petitioners. 9. With the above observation, the petition stands disposed of.
