JUDGMENT Shivashankar Amarannavar, J. - Learned counsel for the appellant submits that DNA report is subsequent to the passing of the impugned order and therefore, now he intends to withdraw this appeal with liberty to file bail petition before the Special Court. He also files a memo and it reads thus: 'The appellant respectfully prays for this Hon'ble Court may dismissed as withdrawn the above said appeal in the interest of justice and equity.' 2. In view of the aforesaid submission and memo, appeal is dismissed as not-pressed with liberty to file bail petition before the Special Court.
