ORDER (Oral) C. Hari Shankar, J. This petition was preferred before this Court under Article 226 of the Constitution of India, despite the fact that the petitioner has preferred an appeal against the impugned order dated 22 June 2023 passed by the learned Debt Recovery Tribunal-1 before the learned Debt Recovery Appellate Tribunal (the DRAT). The petitioner nonetheless moved the present writ petition under Article 226 of the Constitution of India as, according to Mr. Shukla, learned Counsel for the petitioner, the learned DRAT is not sitting. 2. Learned Counsel for the respondents submits, on the other hand, on instructions, that the DRAT is not only sitting but is also disposing of matters. 3. In view thereof, Mr Kirti Uppal, learned Senior Counsel for the petitioner submits, on instructions, that the petitioner would withdraw the petition and move the learned DRAT to obtain appropriate relief. 4. Reserving liberty with the petitioner to do so, the petition stands disposed of.
