JUDGMENT Arindam Sinha, J. - Mr. Pattanaik, learned advocate appears on behalf of applicant and submits, there has been wilful and deliberate violation of order dated 11th May, 2022 passed by co-ordinate Bench inasmuch as inspite of it being recorded therein that the authority had found his client to be eligible for benefit under rural housing scheme, nothing has been done. 2. Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of alleged contemner. 3. Prayer in the writ petition was for decision to be taken on petitioner's representation dated 19th February, 2020 to immediately provide him house either under Biju Pucca Ghar Yojana or under Pradhan Mantri Awas Yojana. The writ petition was disposed of by coordinate Bench on order dated 7th September, 2020, whereby there was direction upon the authority to pass appropriate order on the representation, within a period of three months. Applicant filed CONTC no.5557 of 2021, which was dealt with by coordinate Bench on order dated 11th May, 2022. The contempt proceeding was dropped on recording submission made on behalf of the authority that it reveals applicant was eligible to get house under rural housing scheme. Record in said order is also that further steps had been taken on 18th April, 2022, by which the Government had been moved for taking necessary steps for inclusion of name of applicant in the Awas list so as to enable Block Administration to provide house in his favour. 4. There cannot be cognizance of contempt on an order dropping the contempt proceeding. However, writ petition to enforce the entitlement can be maintained. 5. With above observations, the contempt application is disposed of.
