ORDER Heard learned counsel for the petitioner and the State. 2. The petitioner in the present case is questioning the order dated 02.03.2022 bearing letter no. Urdu Nirdeyshaley 61/96, 202 passed by Director of Urduu Nirdeshaley, Government of Bihar, Cabinet Secretariat Department, Patna as contained in Annexure-1 to the writ application whereby and whereunder the petitioner has been transferred as Assistant, Urdu Translator from the Block Office, Pusa in the District of Samastipur to ‘Urdu Bhasha Koshang Samaharnalay, Rohtas’. 3. It appears on perusal of the records that the petitioner has relied upon a resolution as contained in Annexure ‘2’ to the writ application issued by the order of the Hon’ble Governor of Bihar. According to Annexure ‘2’, this resolution has been issued providing the guidelines for transfer of the employees of the Raj Bhasha Department in accordance with the resolution of the Cabinet Secretariat Department, Government of Bihar. The Cabinet Secretariat has issued the resolution earlier in exercise of the powers under sub-Rule (3) and (5) of Rule 22 of the Rules of Executive Business. The sheet anchor of the argument of the petitioner is that he cannot be transferred outside Darbhanga Commissionary and paragraph ‘7’ of the guidelines of the Raj Bhasha Department still operates. 5. This Court called upon learned counsel for the State to answer the submissions advanced on behalf of the petitioner particularly as regards the existence of Annexure ‘2’ to the writ application. The State Respondent Nos. 2 and 3 filed a supplementary counter affidavit which has been sworn by the Director, Urdu Directorate, Cabinet Secretariat Department, Bihar, Patna. In paragraphs ‘7’ and ‘8’ of the supplementary counter affidavit, it is stated that initially the Department of Cabinet Secretariat and Co-ordination Department had issued a resolution dated 25.10.1980 with regard to the posting and transfer policy of the Government servants. Later on, the Department of Raj Bhasha, Bihar, Patna had adopted the said resolution and issued resolution vide memo no. 317 dated 28.04.1998. It is this resolution which is Annexure ‘2’ to the writ application. 6.

It is the case of the State that the resolution of Raj Bhasa Department was based on the resolution of the Cabinet Secretariat and Co-ordination Department. The Department of Raj Bhasha has merged with the Department of Cabinet Secretariat and it was re-nomenclatured as Directorate of ‘Raj Bhasha’ and ‘Urdu Directorate’ under the Cabinet Secretariat Department. Thereafter, the Department of Cabinet Secretariat, Bihar, Patna had formulated the new ransfer/posting policy for the Government servants working in different Departments in the State of Bihar. The resolution vide Memo No. 434 dated 01.03.2007 issued by the Cabinet Secretariat Department has not specifically repealed the resolution dated 28.4.1998 (Annexure ‘2’) but because the Department of Raj Bhasha has merged into the Department of Cabinet Secretariat and became Raj Bhasha Directorate under the Cabinet Secretariat Department, therefore, the resolution of the parent Department i.e. Department of Cabinet Secretariat became effective upon it and all the transfer and posting are being governed by the resolution dated 01.03.2007 and for this reason the resolution of the erstwhile Department Raj Bhasha became ineffective and non-operational. 7. Learned counsel for the petitioner has drawn the attention of this Court towards the statements made in the reply of the petitioner to the earlier counter affidavit of the State. Learned counsel submits that the resolution dated 28.04.1998 bearing memo no. 317 is still operative. It is stated that there are three different Cabinet Secretariat (1) Cabinet Secretariat Urdu Directorate, Raj Bhasha, Patna, Bihar, (2) Cabinet Secretariat Hindi Directorate, Raj Bhasha, Patna, Bihar and (3) Bihar Sarkar Mantri Mandal, Sachivalaya and Samanbay Vibhag, Bihar, Patna). It is his submission that the Urdu Raj Bhasha was not under any Cabinet Secretariat till 01.03.2007, therefore, the directions contained in the Resolution of 2007 cannot be imposed upon the employees of Urdu Raj Bhasha. 8. Learned counsel has further submitted that as per the policy, transfer should have been effected in the month of June which has not been followed and further it is stated that the petitioner has only been transferred leaving others who are stationed at one place in the district of Samastipur for more than 12 and 15 years. This Court having heard learned counsel for the petitioner and the State as also on perusal of the records finds that the sheet anchor of the argument of the petitioner is Annexure ‘2’ to the writ application which is the resolution of the Raj Bhasha Department. A careful reading of the opening paragraph of Annexure ‘2’ would show that this resolution admits in unambiguous words that it is being issued in accordance with the resolution issued by the Cabinet Secretariat. Therefore, this Court understands that the genesis of Annexure ‘2’ is the resolution of the Cabinet Secretariat. In its counter affidavit, the respondents have categorically stated that in the light of the State Government policy and procedure with regard to transfer/posting, an up-to-date guideline was issued by the Cabinet Secretariat Department vide Departmental Resolution (Sankalp) as contained in Letter No. 434 dated 01.03.2007. A copy of the same has been brought on record as Annexure ‘C’ to the counter affidavit. This Court has perused the same. 10. The Resolution dated 01.03.2007 refers the earlier Resolution of the Cabinet Secretariat and Co-ordination Department bearing Resolution No. 3918 dated 25.10.1980 and the subsequent amendments brought into the same vide Resolution No. 2079 dated 18.11.2006. A bare reading of the Resolution of 01.03.2007 would show that it applies to all the Government employees and the resolution lays down the complete procedures and competence. This resolution has been published in the Bihar Extraordinary Gazette and a copy of the same has been sent to all the Departments/Head of the Departments/all the Commissioners/all the District Magistrates.

On the face of the pleadings available on the records and the content of the Resolution dated 01.03.2007, this Court is of the considered opinion that the Resolution No. 434 dated 01.03.2007 has been published by revisiting the transfer policy which was contained in Resolution No. 3918 dated 25.10.1980 as amended vide Resolution No. 2079 dated 18.11.2006. There is a specific submission that it is this resolution of the Cabinet Secretariat and Co-ordination Department which is in existence and will govern the Government employees. Even Annexure ‘2’ on which the petitioner relies was an offsuit of the earlier resolution of the Cabinet Secretariat. 12. This Court has, therefore, no iota of doubt that the petitioner cannot be allowed to contend that Annexure ‘2’ still exists. To this Court, it is crystal clear that Annexure ‘2’ cannot be given effect to, by ignoring the decision of the Government as contained in Resolution No. 434 dated 01.03.2007. This argument, therefore, fails. 13. As regards the other submissions that the transfer has been effected in a month other than June and that there are some other persons who are posted at Samastipur for more than 12-15 years would not make any difference in the decision of this Court. Those are not the grounds on which an order of transfer of this petitioner may be interfered with. 14. This writ application is dismissed. 15. The interim order, if any, stands vacated.
