JUDGMENT : Alok Kumar Verma, J. On 20.07.2023, present applicant was granted regular bail in connection with the Case Crime No.0004 of 2023, registered at police station Thal, Pithoragarh, District Pithoragarh. Applicant is in judicial custody under Sections 406, 420, 120B of the Indian Penal Code, 1860 and Section 3 of the Uttarakhand Protection of Interests of Depositors (In Financial Establishments) Act, 2005. 2. Heard Mr. Bhupesh Kandpal, learned counsel for the applicant and Mr. V.S. Rathore, learned A.G.A. for the State. 3. Mr. Bhupesh Kandpal, Advocate, contended that the Bail Application (BA1 No.1577 of 2023) was filed for grant of regular bail under Sections 420, 120B of the Indian Penal Code, 1860 and Section 3 of the Uttarakhand Protection of Interests of Depositors (In Financial Establishments) Act, 2005. He has further submitted that apart from the said offence, applicant is also in judicial custody under Section 406 of the Indian Penal Code, 1860. 4. In the facts and circumstances of the case, without expressing any opinion as to the merit of the case, present applicant-Smt. Madhuri Gahlaut is granted regular bail under Section 406 of the Indian Penal Code, 1860 in connection with the Case Crime No.0004 of 2023, registered at police station Thal, Pithoragarh, District Pithoragarh, on the same terms and conditions, as imposed by the order dated 20.07.2023, passed in BA1 No.1577 of 2023. 5. Bail Application (No.1647 of 2023) is allowed accordingly.
