ORDER : Petitioner filed the above writ petition seeking following relief: “… to issue a Writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in issuing appointment order vide proceedings No.386/2017/C.D.P.O dated 29.08.2018 in appointing the 5th respondent as Anganwadi Helper of Govindapuram village, Laveru Mandal, Srikakulam District as illegal, arbitrary and violation of G.O.Ms.No.18 dated 15.05.2015 Women Development, Child Welfare and Disabled Welfare Department and set aside the same and consequently direct the respondents 2 to 4 to consider the petitioner’s candidature being Anganwadi Helper of Govindapuram village, Laveru Mandal, Srikakulam District.” 2. The District Collector issued notification dated 21.07.2017 calling applications to fill the post of Anganwadi Worker/Helper/Mini Anganwadi Worker in the villages of Govindapuram and Paidayyavalasa of Laveru Mandal. Petitioner made application for the post of Anganwadi Helper. Petitioner secured 329 marks out of 600 marks in 10th class. Petitioner attended to interview on 18.10.2017. 3. Petitioner came to know that 5th respondent, who attended the interview was selected. According to petitioner, 5th respondent secured 233 marks out of 600 marks in 10th class. Petitioner is meritorious than 5th respondent, however, without considering her candidature, 5th respondent was selected. 3rd Respondent vide proceedings No.386/2017/C.D.P.O dated 29.08.2018 appointed 5th respondent as Anganwadi helper for the Govindapuram village. Hence, this writ petition is filed. 4. This Court ordered to issue notice to 5th respondent. 5. Learned Government Pleader for Women Development and Child Welfare, passed on the instructions issued by 4th respondent. As per the instructions, petitioner and 5th respondent applied for the post of Anganwadi Helper of Govindapuram village and both of them were called for interview held on 18.10.2017. The selection committee consists of 1) CPDO, ICDS Project, Ranasthalam; 2) Project Director, DWCDA, Srikakulam, 3) DM&HO, Srikakulam, 4) RDO, Srikakulam and 5) Chairman, District Collector, Srikakulam. Interview was conducted as per the guidelines and rules framed by the Government of Andhra Pradesh. The required minimum qualification for the post is 10th class and the marks secured in 10th class alone is not a criteria for selection of candidate. The selection will be finalized basing on their performance at the interview and over all marks of the candidate like IQ, mental capacity and capacity of understanding. After interview petitioner secured 62 marks out of 100 and 5th respondent secured 64 out of 100.

As per the particulars furnished along with written instructions, 50 marks each were awarded to petitioner and 5th respondent for possessing 10th class. In the interview, petitioner got 12 marks and 5th respondent got 14 marks. Hence, 5th respondent was selected for the post of Anganwadi helper of Govindapuram village. 7. Heard Sri K.J.V.N.Pundareekakshudu, learned counsel for petitioner and the learned Government Pleader for Women Development & Child Welfare for respondents 1 to 4. 8. Learned counsel for the petitioner would submit that the petitioner is more meritorious than 5th respondent, in fact, petitioner secured 329 marks in 10th class and she also passed intermediate, whereas 5th respondent passed 10th class in compartmental and only secured 233 marks. He would submit that though the petitioner is meritorious than 5th respondent, her candidature was not considered and hence, the proceedings are liable to be set aside. 9. Learned Government Pleader for Women Development & Child Welfare would submit that every candidate who possessed 10th class qualification will be given 50 marks and in the interview petitioner secured 12 marks, whereas 5th respondent secured 14 marks and considering the overall marks, 5th respondent was selected and he thus, prayed to dismiss the writ petition. 10. The District Collector issued notification dated 21.07.2017 calling applications for the post of Anganwadi Helper in the villages of Govindapuram and Paidayyavalasa of Laveru Mandal. Petitioner and 5th respondent, who belong to Govindapuram village applied for the said post. The selection committee consisting of five officials, interviewed the petitioner and 5th respondent on 18.10.2017. As per the material placed before this Court, petitioner secured 12 marks in the interview, whereas 5th respondent secured 14 marks. Considering the total marks, 5th respondent was selected. Accordingly, 3rd respondent issued appointment proceedings dated 29.08.2018. Since the respondent authorities followed the procedure and appointed 5th respondent, this Court does not find any irregularity or illegality in the order of appointment of 5th respondent as Anganwadi helper of Govindapuram village. Hence, this Court finds no merits in this writ petition and the same is liable to be dismissed. 11.
