JUDGMENT V. Kameswar Rao, J. (Oral)--The challenge in this writ petition is to an order dated July 06, 2018 passed by the Central Administrative Tribunal, Principal Bench (in short "Tribunal") in O.A. 1937/2016, whereby the Tribunal has dismissed the O.A. and granted three weeks time to the petitioner to submit the explanation for the chargesheet, not already filed. 2. Suffice to state that pursuant to the issuance of the chargesheet, the proceedings have been held against the petitioner, resulting in an order of penalty dated November 28, 2022 effecting the pension. 3. The only issue raised by the learned counsel for the petitioner who has since retired is that the petitioner though has been paid the GPF, but has not been paid the other retiral benefits taking into account the penalty of cut of 10% pension for a period of two years. 4. Mr. Singh, on instructions, states that all the retiral benefits shall be released to the petitioner within a period of eight weeks taking into account the penalty imposed in the departmental proceedings. 5. The statement of Mr. Singh is taken on record. 6. The petition is disposed of.
