ORDER : Prayer: Transfer CMP is filed under Section 24 of the Civil Procedure Code, to withdraw the M.O.P.No.666 of 2022 on the file of the Family Court, Pondicherry and transfer the same to the Family Court, Cuddalore. The Transfer Petition is filed by the petitioner / wife to transfer the M.O.P.No.666 of 2022, pending on the file of the Family Court, Pondicherry to the Family Court, Cuddalore. 2. The marriage between the petitioner / wife and the respondent / husband was solemnised on 11.07.2019 as per Hindu Rites and Customs. One female child was born from and out of the wedlock between the petitioner and the respondent and the child is now with the custody of the petitioner. Due to misunderstanding, the petitioner and the respondent are living separately. 3. The learned counsel for the respondent / husband made a submission that the respondent is ready and willing for re-union and made several requests to the petitioner / wife for re-union. In view of the said submission made, the parties are directed to be present before this Court and accordingly, both the petitioner and the respondent are present before this Court. 4. With the assistance of the respective learned counsels appearing on behalf of the parties and through conciliation, the petitioner and the respondent agreed to live together. 5. In this regard, the respondent / husband agreed to reside nearby the parents house of the petitioner / wife at Cuddalore. In this regard, they can rent a house at Cuddalore nearby the house of the parents of the petitioner / wife and accordingly lead their matrimonial life. The respondent / husband has agreed to maintain the petitioner and the minor child and further said that he will resolve their disputes / misunderstanding amicably. 6. The petitioner / wife in person also agreed for re-union accepting the undertaking given by the respondent / husband. 7. In view of the said compromise between the parties, the respondent / husband undertakes to withdraw the Divorce case filed by him in M.O.P.No.666 of 2022, pending on the file of the Family Court, Pondicherry. 8. 6. In view of the said compromise between the parties, the respondent / husband undertakes to withdraw the Divorce case filed by him in M.O.P.No.666 of 2022, pending on the file of the Family Court, Pondicherry. 8. In view of the re-union of the petitioner and the respondent to resume their matrimonial home, no further adjudication is required and in view of the undertaking, the M.O.P.No.666 of 2022, now pending on the file of the Family Court, Pondicherry stands withdrawn and the Family Court, Pondicherry may accordingly close the case file. 9. Accordingly, the Transfer Petition filed in Tr.C.M.P.No.1332 of 2022 stands disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
