JUDGMENT Rohit Arya, J. - This is first bail application under Section 438 Cr.P.C. The applicant is apprehending her arrest in connection with Crime No.365/2022 registered at Police Station Dehat, District Bhind for the offence punishable under Sections 306, 498-A of IPC and under Section 3/4 of POCSO Act. Applicant is the wife of the uncle-in-law of the deceased. 2. As per prosecution story, the deceased Chandni was married to Mehandi Hashan S/o Shri Saleem Khan on 11/04/2015. It is alleged that there has been demand of dowry of Two Lakh Rupees from the parents of deceased by persons named in the FIR. Under such circumstances, on the fateful day, she committed suicide. Accordingly, case has been registered against her. 3. Investigation is complete. Challan has been filed. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated. There is no allegation of act much less overt act of commission of crime on the part of the applicant abetting the crime. She otherwise living separately at a distant place. The entire family has been robbed in under the pretext of demand of dowry. The applicant is a lady and has no criminal antecedent. Applicant is prepared to cooperate in the investigation and shall abide by such terms and conditions, this Court deems fit and proper, if she is protected against arrest. 5. Per contra, learned counsel for the respondent-State opposes the bail application supporting the order impugned. 6. Upon hearing learned counsel for the parties and perusal of the case diary and material placed before this Court, this Court is of the view that the applicant is entitled for protection against her arrest and is hereby granted anticipatory bail. 7. Accordingly, the instant application is allowed and it is directed that in the event of arrest, present applicant be released on bail on her furnishing personal bond in the sum of Rs.2,00,000/- (Rs.Two Lac only) with one solvent surety of the same amount to the satisfaction of the Arresting Authority (Investigation Officer) with following further conditions :- (i) the applicant shall abide by the terms and conditions of various circulars and orders issued by the Government of India and the State Government as well as the local administration from time to time in the matter of maintaining social distancing, physical distancing, hygiene etc., to avoid proliferation of Novel Corona Virus (Covid-19).
(ii) the applicant shall cooperate in the investigation and made herself available before the Investigation Officer, as and when, she is called. Default in that regard, shall lead to cancellation of her bail. (iii) the applicant shall further abide by the other conditions enumerated in sub-Section (2) of Section 438 of Cr.P.C. (iv) violation of conditions, State is free to apply for cancellation of bail. 8. Observations made on facts touching merits of the case are only for the purpose of deciding the bail application and shall not have any bearing on the pending trial. 9. Registry is directed to send a copy of this order to all the concerned including the concerned Station House Officer of the Police Station for information and necessary action. Certified copy as per rules.
