JUDGMENT : S.M. SUBRAMANIAM, J. Prayer: Appeal Suit is filed under Section 96 of the Code of Civil Procedure read with Order 41 Rule 1 of the Code of Civil Procedure, to set aside the Judgment and Decree in O.S. No. 123 of 2018 passed by the II Additional District Judge, Chidambaram dated 19.09.2019. 1. The Appeal Suit in A.S. No. 20 of 2021 has been filed to set aside the Judgment and Decree dated 19.09.2019 passed in O.S. No. 123 of 2018 by the II Additional District Judge, Chidambaram. 2. The learned counsel for the appellant has made a submission that the issues between the parties are settled out of Court and he has chosen to withdraw the Appeal Suit. 3. Accordingly, the Appeal Suit in A.S. No. 20 of 2021 stands dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed. 4. The appellant is entitled for the refund of Court fee as contemplated under the Rules.
