JUDGMENT : 1. Heard Shri Munna Tiwari, learned counsel for the petitioner and Shri Abhinav Chandra, learned Standing Counsel for the State. 2. On 16.12.2022, this Court passed the following order; "Grievance of the petitioner is that even though the petitioner had applied for the matter to be decided through arbitration and had also deposit requisite fee on 14.11.2022, the arbitration had not commenced. Learned Standing Counsel to take instructions in the matter. Place this case on on 18.01.2023 as fresh. By that date we expect that an arbitrator would be appointed and the arbitration would commence." 3. Today, learned Standing Counsel states on instruction that a first information report has been lodged and final report has also been submitted. 4. In view of the statement made by learned Standing Counsel, we do not find any good reason to entertain this writ petition. 5. Therefore, without expressing any opinion on merits of the case of the petitioner, the writ petition is dismissed leaving it open for the petitioner to pursue the matter before the arbitrator.
