JUDGMENT : Alok Kumar Verma, J. Revisionist– accused Pankaj Singh Jeena was convicted under Section 60(1) of the United Provinces Excise Act, 1910 (as applicable in the State of Uttarakhand) (in short, “Act, 1910”) and sentenced to undergo two years imprisonment along with a fine of Rs.20,334/-. 2. Against the said judgment dated 03.08.2023, passed by learned Judicial Magistrate/Senior Civil Judge, Pithoragarh in Criminal Case No.58 of 2022, an Appeal (Criminal Appeal No.51 of 2023) was filed by the revisionist. The said Appeal has been dismissed vide judgment dated 16.10.2023, passed by learned Sessions Judge, Pithoragarh. 3. The case of the prosecution is that 68 pavva (quarts) and 14 bottles of liquor (whiskey and rum) were recovered from the possession of the revisionist on 13.05.2020, but, only two bottles were sent for examination. 4. Admit. 5. Mr. Amit Kapri, Advocate, submitted that the revisionist is in judicial custody since 21.11.2023. He does not have any criminal antecedents. He has requested to reduce the sentence of the revisionist to the period he has already spent in judicial custody. 6. Mr. V.K. Gemini, learned Deputy Advocate General, submitted that there is nothing on record to show that the revisionist had earlier been involved in any unacceptable activities. 7. Section 60(1) of the Act, 1910 does not prescribe any minimum sentence of imprisonment. 8. In the facts and circumstances of the case, the sentence of imprisonment of the revisionist is reduced to the sentence already undergone by him subject to the revisionist paying Rs.20,334/- fine be paid within one month from the date of this judgment. If fine is not paid consequences will follow. 9. Revisionist-Pankaj Singh Jeena is directed to be released from judicial custody. 10. Registry is directed to send a copy of this judgment forthwith to the Superintendent of District Jail, Almora for taking necessary action. 11. The present Criminal Revision (No.925 of 2023) is disposed of accordingly.
