JUDGMENT Arindam Sinha, J. - Ms. Patro, learned advocate appears on behalf of applicant. Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of alleged contemner and submits, he has instruction that office of alleged contemner directed Block Development Officer (BDO), Badachana to take appropriate steps for inclusion of name of applicant, when Ministry of Rural Development enables addition option in the software, in future. Accordingly applicant's representation was disposed of as directed by order dated 10th January, 2022. Hence, there has been compliance. He tenders unqualified apology on behalf of his client for delayed compliance. In fairness, he refers to judgment dated 3rd January, 2023 of this Bench in CONTC no.6372 of 2022 (Sankarsana Nayak v. Kalyana Sourav Dash, B.D.O., Bhuban) and submits, the contempt application be disposed of as covered thereby. 2. The contempt application is covered by said judgment dated 3rd January, 2023. Observation made therein that it goes without saying, applicant's entitlement, as eligible to the benefit, is to be considered in respect of the scheme, if and when revived or under any new future like scheme, is also applicable to applicant herein. 3. The apology and compliance are accepted. The proceeding is dropped. 4. The contempt application is disposed of as above.
