JUDGMENT 1. The short ground on which the Petitioner challenges an order dated 14th May, 2004 passed by the Settlement Officer in Appeal Case No.4176 filed by the State against the vendor of the present Petitioner i.e., Shri Sandeep Das and others, is that no notice was issued to the present Petitioner, i.e., the subsequent purchaser, before the order was passed directing entry in the name of the Government of Odisha in the Record of Rights (RoR) pertaining to the land in question. 2. I.A. No.12876 of 2021, an application filed for impleading inter alia Shri Sandeep Das (Vendor of the Petitioner) as an Opposite Party in the writ petition. 3. A perusal of the impugned order reveals that the present Petitioner was not made a party to the said objection case. Therefore, there was no occasion for notice to be issued to the present Petitioner before the impugned order was passed. 4. On that short ground, the impugned order dated 14th May, 2004 is set aside and Appeal Case No.4176 is restored to the file of the Assistant Settlement Officer (ASO), or the Tahasildar now exercising those powers, before whom it will be listed for directions on 1st March, 2023. On that date the Petitioner will appear along with downloaded copy of the order. 5. The ASO or the Tahasildar as the case may be will now proceed afresh and decide Objection Case No. 4176 after hearing all the necessary and proper parties including the Petitioner, dispose of the said appeal case by a reasoned order within a period of four months thereafter. Till such time, the status quo as on today shall be maintained by the parties. 6. The writ petition is disposed of in the above terms.
