ORDER : 1. Heard Ms. Vibha Datta Makhija, learned senior counsel appearing for the petitioner and Mr. Arjun Garg learned counsel appearing for the respondent. 2. The petitioner before this Court runs, inter alia, D.Ed. Course. This course is being conducted by the petitioner for the last 17 years. All the same, there is an annual renewal of this course which has to be done by the Board of Secondary Education. For the year 2023-2024, the petitioner could not deposit the renewal fee in time and there was a delay of 11 days. The renewal has been rejected by the Board on the ground that the petitioner had deposited the fee belatedly and the fee which has been deposited has been confiscated. The petitioner prays for quashing of the order dated 15.05.2023. The undisputed fact in this case is that, the renewal has been done in this case from time to time. Mr. Arjun Garg, learned counsel also fairly admits so and say that the mistake on the part of the petitioner is only technical. 3. Under these circumstances, we quash and set aside the order dated 15.05.2023. The petitioner shall be granted renewal of affiliation for the year 2023-2024 subject to paying costs of Rs.25,000/-to the Registry of this Court which shall be deposited with the Supreme Court Middle Income Group Legal Aid Society account within two weeks. 4. The petitioner is also permitted to participate in the counseling and admission process for admission of students in D.El.Ed. Course. 5. The writ petition stands disposed of accordingly.
