ORDER : 1. The petitioner had approached the Rajasthan High Court with a writ petition seeking transfer of investigation of a crime to an independent investigating agency other than the local police. 2. By the impugned order dated 17 January 2023, the High Court has closed the proceedings and dismissed the writ petition noting that the investigation has already been completed and that the prayer seeking transfer of investigation of the FIR has become infructuous. 3. We have heard learned counsel for the petitioner and perused the materials on record. 4. It appears that, prima facie, offence under sections 323/341/143 of IPC has been found to be committed by 33 accused persons although, according to the petitioner, there are about 49 persons who were identified as accused by the Commissioner appointed by the High Court. It has also been argued on behalf of the petitioner that investigation of the crime has not been conducted properly and fairly. 5. This is not the appropriate stage for this Court to examine the points raised by the petitioner. The Code of Criminal Procedure provides sufficient remedies to the petitioner, if she is aggrieved by the police report which ultimately is to be submitted by the police under Section 173(2) thereof before the jurisdictional magistrate. Keeping all points open for the petitioner to agitate before the appropriate forum, this Special Leave Petition stands dismissed. 6. Pending applications, if any, stand disposed of.
