JUDGMENT I.A. No.74 of 2023 1. This matter is taken up through hybrid arrangement (virtual / physical) mode. 2. The Appellant (Bukuni @ Kharabela Majhi) by filing this application has prayed for grant of interim bail. 3 Heard learned Counsel for the Appellant and learned Additional Standing Counsel for the State. 4. Taking into account the submissions made and on going through the averments taken in the Application as well as the documents annexed thereto; further keeping in view the fact that the presence of the Appellant at this hour at his home is necessary as his Grandmother having died on 07.01.2023 his father is completely bed ridden, We are inclined to grant interim bail to the Appellant (Bukuni @ Kharabela Majhi) for a period of four (4) weeks from the date of his actual release from custody. 5. Accordingly, it is directed that the trial court shall release the Appellant (Bukuni @ Kharabela Majhi) on interim bail in S.T. Case No.10-134 of 2017 by the learned Additional Sessions Judge, Balasore for a period of four (4) weeks from the date of his actual release from custody on such terms and conditions as deemed just and proper by the Court in seisin of the case with further condition that the Appellant shall positively surrender before the said Court after expiry of period of interim bail. 6. The I.A. is, accordingly, disposed of. CRLA No.1066 of 2022 1. List this matter in the week commencing 10th April, 2023. 2. Urgent certified copy of this order be granted on proper application.
